Taiwanese Court & Parliament abolished SECTION 55

Taiwanese Constitutional Court ruled that a law similar to famiLEE LEEgime's notorious Section 55 is a violation of constitution and Invalidated that law. Resulting 191 members of notorious triads to be released from prison!

Laws that are in violation of constitution can not stand. In this case some how the Taiwanese parliament past the abortion of this law after their CJ ruled that this law is in violation of Taiwanese Constitution.

Recently, this is the 2nd time of such change of law. The previous one I posted on Internet was the Assembly & Procession law that was protested by students:

That Assembly & Procession Law had been amended after student's protest against that law. Now it is the law equivalent to famiLEE LEEgime's Section 55 that had been used to detain gangsters.

檢肅流氓條例廢止　191人將釋放

<table class="left" cellspacing="0"> <tbody><tr><td><label></label></td></tr> </tbody></table>因為被大法官宣告違憲，立法院今天三讀通過，廢止檢肅流氓條例，也就是在馬總統公告廢止當天，全台灣就會有將近2百位「流氓」被無條件釋放。法務部和內政部強調，這是國內人權的一大進步，不過對於民代憂心，可能會有所謂「重大流氓」被放出來擾亂治安，警政署強調會加強訪查，絕對沒有法律空窗。


廖了以和王清峰一起召開記者會，要宣示治安沒有假期，法律沒有空窗，因為立法院已經三讀通過，廢止檢肅流氓條例，將會有過去認定的流氓獲得釋放。國民黨立委吳育昇：「不外乎這些所謂的竹聯、四海、天道盟等等道上的兄弟。」


內政部長廖了以：「告訴所謂有一些不法行為，過去所稱的黑道流氓，有僥倖的心情，認為有空窗期存在，我們在這邊宣示，絕無空窗期存在。」


檢肅流氓條例，因為有超過1/3的條文違憲，所以立法院三讀廢止，也就是在馬總統公告當天，因為這個條例被關的受刑人，就會立刻獲得釋放。法務部次長黃世明：「受感訓處分的人是420位，假如說流氓條例，總統公告廢止以後，我們可以馬上釋放的大概有191位。」


警政署長王卓鈞：「我們會請各轄區警察局，依照規定來定期查訪。」


原本被認定為流氓的這191人，即將在農曆年後回家，同時還有1千位被提報流氓的人，根本不用坐牢就直接結案，警方擔心會對治安產生衝擊，決定加強訪查，只是有哪些重大流氓被放出來，相關單位很低調，什麼都不透露。

Actually, I don't how come many Singaporeans, especially "pre-independence" Singaporeans, come to refer to the Internal Security Act or detention without trial as "Section 55".

What I understand is that the ISA was incorporated into Singapore laws in 1963 from Malaysian laws due to merger with Malaysia. After demerger and independence, the ISA in Singapore was revised to become Chapter 115 in 1970, and then Chapter 143 from 1985 till now. The Section in the Chapter enpowering arrest is Section 46, not 55.

Section 55 is even more powerful. It enpowers the police to destroy buildings deemed to be security risks.

What does Taiwan really lead in? If they are so good, why don't your country's leadership pursue stronger ties with them but instead, with the People's Republic of China?

A compelling reason would be that, China is on the rise, but more significantly, Taiwan has no future compared to China, bluntly speaking.

Your Jack Neo is alright, I watched some of his movies on my trips here and well, I think they are alright. Bear in mind that your country gained independence only in the middle of the 60's, and it is one of the youngest countries in the world. So going with this point, Singapore is a young country that has yet to achieve the technical and industrial knowhow unlike industralized countries like Taiwan and Japan and America where they have longer and deeper histories.

Especially for the music, movies and serials your country's locals are still feeling their way around, and experimenting with things, so it is unfair for you to talk down on your local Directors like Jack who is making the best out of the environment he's in. In some ways he parallel's China's Zhang Yimou, IN THE SENSE THAT there are, unconventional things they would like to depict in their creations but would first need approval from the authorities (nothing wrong with that as they have their own methods of caring for their people as well as their own reasons).

Also, if you use your head more and talk less, you would know that Taiwan in many aspects, ape the trends and cultural mindsets of that of Japan, over their own. Their game shows are copied from the Japanese ones (and they STILL do a BAD JOB - "Super Sunday" anyone?), their youths copy Japanese hairstyles and dressings (and despise their own peers if they don't do the same) and even their triads wear clogs and carry short knives like the Yakuza.

So there is nothing really special about that renegade province you call Taiwan. Even their dramas aren't as good as the ones in Hong Kong. You sure are a frog in the well Singaporeanese to not know all these.

And China doesn't need Taiwan really. They have a fair share of businessmen and entrepreneurs who support their own country and their economy. Taiwan needs China more. Even their water supply comes from China, so spare us that big talk.

My last words to you would be: "For any young or matured country to economically or politically follow a worthless country like Taiwan, is to stubbornly remain rooted to a sinking ship. Both are incredible stupidities."
