A MOTORIST whose negligence caused the death of a motorcyclist on an expressway last year was fined $5,000 and banned from driving for three years yesterday.

A coroner had found that the negligence of German commercial manager Frank Hoewelkroeger, 35, resulted in the death of Mr Sia Chong Shyang along the Seletar Expressway on Jan 5 last year. Hoewelkroeger was named a potential defendant at the coroner's inquiry.

Mr Sia, 27, a Malaysian construction worker, died from multiple injuries.

Hoewelkroeger, a Singapore permanent resident, admitted failing to keep a proper lookout when he suddenly swerved from the right lane into the centre lane, hitting Mr Sia's motorcycle and causing him to be flung from the machine onto the road and into the path of a trailer which ran over him.

Deputy Public Prosecutor Adrian Loo told the court that Hoewelkroeger was in the car with his wife when he suddenly swerved the vehicle after seeing that traffic in front of him had come to a standstill. By failing to keep a proper lookout, his car hit Mr Sia's motorcycle, said the DPP.

Mr Christopher Bridges said in his written mitigation plea that his client, who has 15 years' driving experience, had heard screeching sounds of tyres followed by a series of collision noises on the day of the incident. He noticed the car in front of him had braked abruptly, and he applied his brake partially.

The coroner ruled that Mr Hoewelkroeger's negligence had resulted in the motorcyclist's death even though Mr Heng Hai Cheng was the driver of the trailer that ran over him.

THE death of a motorcyclist on an expressway earlier this year was due to the actions of a probationary driver who had suddenly switched lanes and hit the rider.

As a result, Malaysian construction worker Sia Chong Shyang, who was riding along the right side of Seletar Expressway's centre lane, was flung from his motorcycle and then run over by a trailer. He died on the spot.

On Wednesday, State Coroner Victor Yeo found that the 27-year-old's death on Jan 5 was due to the negligence of the first potential defendant, 33-year-old marketing manager Frank Hoewelkroeger.

The coroner said that while he was mindful that the motorcyclist was also run over by Mr Heng Hai Cheng's trailer, he was satisfied that the 60-year-old, named the second potential defendant, could not have avoided hitting the victim.

But as to whether any action will be taken against both men, Mr Yeo said he would leave it to the Attorney-General's Chambers.

Senior Staff Sergeant Colin Ong from the Traffic Police stated in his investigation report that Mr Hoewelkroeger, a permanent resident from Germany and a P-plate driver, was with his Singaporean wife in their car that morning, when he decided to filter to the centre lane from the right lane to avoid two cars which had stopped in front of him.
