Chinese language words cursing a black-hearted political opponent to live a short live and die young.

This is name calling during election period. 1st trial found him guilty and sentenced fine NT$6000. He co-defendants also found guilty and fined.

But this is still subjected to further appeals in court.

余天選立委被控以文宣攻擊 1審判罰金6000

（中央社記者黃旭昇台北縣18日電）民進黨籍立委余天被控民國96年競選立委期間，以「黑心夭壽」文宣攻擊同選區候選人朱俊曉，板橋地方法院今天以公然侮辱罪判處罰金6000元，緩刑兩年。本案仍可上訴。


前立委朱俊曉在本屆立委選舉以1926票之差，敗給余天未能連任。他認為，判決結果與競選期間所受傷害，不成比例，且無法遏止日後的惡質文宣競選手法。
判決書指出，余天於96年代表民進黨參選第7屆立委，基於與競選總部政策小組召集人陳昭男共同犯意，由陳昭男製作「黑心夭壽」足以貶抑人格的文宣，經余天簽名認可後，以派報等方式散發。


判決書表示，陳昭男發現這樣的文宣有效，於是另外起意，與民進黨前三重市黨部主委徐文明製作「創啥曉！立委、市長聯手欺騙選民」文宣，散發並且公然侮辱同選區的立委候選人朱俊曉。


全案經朱俊曉提出妨害名譽告訴，3名被告庭訊時坦承犯行，法院審酌余天曾公開道歉判處罰金6000元、緩刑兩年；陳昭男罰金6000元、緩刑兩年；徐文明罰金4000元，緩刑兩年。


朱俊曉表示，競選對手為贏得選舉，惡意謾罵，達到競選目的後，才對外道歉，且沒有公開對當事人表達歉意，根本無濟於事。980518
