Father charged with raping daughter after her confinement period
PETALING JAYA: A father who allegedly raped his daughter just after her confinement period has been charged at the Kangar Sessions Court.
Astro Awani reported that the 54-year-old father of four is accused of raping the 21-year-old twice at a house in Kangar at 9pm on May 30 and 31.
He is also said to have attempted to rape the victim – the youngest of his children – at another location in Kangar on June 1.
The accused was charged under Section 376B of the Penal Code for committing incest.
It carries a jail sentence of at least 10 years up to 30 years and whipping upon conviction.
The accused pleaded not guilty to the charges after it was read by the court interpreter in front of judge Ainul Shahrin Mohamad.
According to Astro Awani, DPP Mohd Izham Ali asked for the accused to be denied bail due to the possibility of the accused disturbing the victim, who is also the main witness, as they lived in the same house.
Izham said the accused should not be allowed bail, describing his action of allegedly raping the victim who had just finished her confinement after giving birth as inhumane.
However, defence lawyer Norharniza Rusli of the National Legal Aid Foundation asked for the court to allow bail as the case was categorised in the allowable bail list.
Norharniza also told the court that the accused would be living in his relative's house in Kuala Ketil, Kedah if he was allowed bail.
Astro Awani reported that judge Ainul Shahrin allowed bail of RM12,000 with two sureties, and ordered the accused to report to the Kuala Ketil police station every week, and not to approach the victim or any family members.
The court set case mention on July 23 for the submission of the full medical report.
