SINGAPORE: A complaint has been raised against MP Raeesah Khan (WP-Sengkang) by the Leader of the House Indranee Rajah after Ms Khan admitted on Monday (Nov 1) to lying in Parliament.

Ms Khan admitted on Monday that she did not accompany a rape victim to the police station as she had claimed earlier in Parliament in August, and that her previous statement on the matter was “untrue”.

She also apologised for alleging that the police mishandled the case of the sexual assault victim.

Speaking after Ms Khan, Ms Indranee said she had "no choice" but to raise a complaint under Section 100 (7b) of the Standing Orders of Parliament, alleging a breach in parliamentary privilege.

WHAT IS PARLIAMENTARY PRIVILEGE?​

Parliamentary privilege means MPs cannot be prosecuted or sued for statements made in Parliament as part of their duties.

This allows MPs to speak freely on significant issues without fear of legal consequences. This immunity only applies to what is said and done in Parliament.

“As Members of Parliament, we are granted privileges. One of those privileges is to be able to speak in Parliament with immunity. Unlike other people, we can do so without fear of prosecution because of the underlying public policy interests, which is to be able to raise things,” explained Ms Indranee in Parliament.

“And it’s very important when we do so, that we must be able to speak truth in this House, and when we assert or make allegations to be able to back them up.”

MPs are "subject to duties and responsibilities", she said, adding that they should not breach that privilege or "abuse it".

“But as Leader of the House, I also have a responsibility, and that is to ensure that in this chamber, all Members of Parliament discharge their duties faithfully and accountably and responsibly, and also that if (there are) any breaches of privilege that has to be dealt with,” she added.

Parliament is a platform that people "look at", and when there are untruths, it "undermines the trust", said Ms Indranee, who is also Second Minister for Finance and for National Development.

WHAT DO THE STANDING ORDERS SAY?​

The section of the Standing Orders invoked by Ms Indranee allows any member to rise at any time to make a complaint alleging a breach of privilege suddenly arising, whenever Parliament is sitting.

If the Speaker of Parliament is satisfied that the matter complained of prima facie - or based on first impression - affects the privileges of Parliament and that it has been raised at the earliest opportunity, the matter will be referred without any question to the Committee of Privileges.

No further proceedings shall be taken on the matter until the committee has reported its findings.

The committee is made up of eight MPs. As members of the committee, Ms Indranee said she and Mr Shanmugam will recuse themselves from the case involving Ms Khan.

The other members of the committee are: Speaker of Parliament Tan Chuan-Jin, Minister for Sustainability and the Environment Grace Fu, Minister for National Development Desmond Lee, Minister for Social and Family Development Masagos Zulkifli, as well as fellow MPs Don Wee (PAP-Chua Chu Kang) and Dennis Tan (WP-Hougang).

The powers of Parliament to act against an MP who engages in "dishonourable conduct, abuse of privilege or contempt" are laid out in Section 20 of the Parliament (Privileges, Immunities and Powers) Act.

According to the Act, Parliament may commit the MP to prison for a term not extending beyond the current session of Parliament, impose a fine not exceeding S$50,000, or suspend the MP from Parliament for the remainder of the current session or for any part.

Parliament can also direct that the MP be reprimanded or admonished by the Speaker.

PREVIOUS INCIDENTS​

The last time an MP was referred to the Committee of Privileges was in 1986.

Then-MP J B Jeyaretnam (WP-Anson) was accused of abusing parliamentary privileges by making unsubstantiated allegations of executive interference in the judiciary.

He was also accused of having "maligned the judiciary by insinuating that they did not exercise their duties in accordance with their oath of office".

The complaint was filed by then-Leader of the House S Dhanabalan, who was Minister for Foreign Affairs at the time.

Mr Jeyaretnam was found guilty of abuse of parliamentary privilege by the committee, and he was fined S$1,000. That report was presented to Parliament in January 1987.

As an MP, he was referred to the committee another two times in 1986 for separate issues.

The most recent report by a Committee of Privileges was in November 1996. Then-Health Minister George Yeo filed a complaint against representatives from the Singapore Democratic Party (SDP), namely Dr Chee Soon Juan, Mr S Kunalen, Mr Wong Hong Toy and Mr Kwan Yue Keng.

Mr Yeo alleged that the four SDP representatives had acted in contempt of Parliament by fabricating data and presenting false or untrue documents with the intent to deceive a committee.

The four men were representing the SDP before a Select Committee on verification of healthcare subsidy of government polyclinics and public hospitals in July 1996 to give oral evidence supporting their written representation.

They were then summoned to testify to the Committee of Privileges in August due to a “purported error” in a chart in their submissions.

The committee eventually found that Dr Chee was "by far, the most culpable", and he prepared the written submission and the charts.

He fabricated data, committed perjury and wilfully gave false answers to cover up the fabrication, among other charges, the committee report said.

The four men were issued fines. Dr Chee was fined S$25,000, Mr Wong was fined S$13,000, Mr S Kunalen was fined S$8,000 and Mr Kwan was fined S$5,000.

On hindsight, she should have consulted with Sylvia and / or Pritam, before she introduced that matter in Parliament in August 2021.

Does SG parliament allow an MP to be kicked out of their party and forced to sit as Independent MP (ie no party?) See this a lot in Canada.

I have not seen this one in SG.

Oh I guess the problem is she is part of a GRC. So if they do that then it calls for a by-election? Oops......
 
She is one MP for the Sengkang GRC.
Perhaps, the Workers Party wi ask her to step down, without triggering a bye election, and ask the other MPs to cover for her.
 
She should automatically quit WP n stopped being an embarrassment to WP..

My Reading is that Pitham has reached bargain plea with PAP. The committee of privilege will give her a tick off police will issue severe warning. WP will ask her to resign but no BE. When Palmer eat mangoes there was no BE. The rest of the team just share the load. Internally already settled.
 
Imuho lying in Parliament is a serious crime about 50% of that of lying in court hence she should get at least a day in jail and/or fine to leepent.

The Workers' Party (WP) MP Raeesah Khan has apologised in Parliament on Monday (Nov 1), saying she "was not present" at the police station during the sexual assault case she alleged was mishandled by the police.
She also revealed that she is a sexual assault survivor.

“I should not have shared the survivor’s story without her consent, nor should I have said that I accompanied her to the police station when I had not. It was wrong of me to have done so,” the 27-year-old told the House.
On Aug 3, while taking part in a debate on empowering women, Raeesah claimed that she had accompanied a 25-year-old rape victim to the police station. In that account, which happened three years ago, she claimed the police officer interviewing the victim had made inappropriate comments about what the victim wore and the fact that she had been drinking.
The exchange in Parliament went viral after the Sengkang MP repeatedly declined to share more details.
The victim's account, Raeesah told the House on Monday, was in fact shared in an anonymous support group for women, but she didn't mention that earlier because she "did not have the courage to publicly admit" she was part of that group.
In her speech today, Raeesah said she was sexually assaulted at age 18 while studying overseas and that the incident traumatised her till today.
"The fear and shame accompanying sexual assault are extreme and long-lasting," she said.
She shared that she "did not have the courage" to report her assault but urged survivors of sexual violence to do so. As a survivor, Raeesah said she wanted to speak up and share this account she heard when speaking on the Motion on Empowering Women.
She extended her apologies to the survivor she quoted, the Singapore Police Force, Parliament, her constituents, WP members and volunteers, her family and her parents.
On Oct 20, the police said they could not identify the sexual assault case that Raeesah raised in Parliament in August. "We cannot confirm that such an incident actually took place," the police said in a statement, adding that she didn't respond to provide more details on the case.
A few weeks earlier on Oct 7, the Criminal Investigation Department's Serious Sexual Crime Branch, which investigates rape offences, had emailed Raeesah, requesting to arrange an interview with by Oct 14.
On Oct 4, Law and Home Affairs Minister K Shanmugam had urged her to share more details of the alleged incident, including the rough date, police station as well as the police officers involved.

SINGAPORE: The Workers' Party said on Tuesday (Nov 2) it has approved the formation of a disciplinary panel to "look into the admissions made" by Member of Parliament Raeesah Khan in Parliament on Monday.

On Monday, Ms Khan admitted to lying in Parliament about details of a rape case that she alleged was mishandled by the police, saying she did not accompany a victim to the police station as she had claimed.

She apologised to the Singapore Police Force and retracted an anecdote she had shared of a rape victim, saying her previous statement on the matter was "untrue".

The MP for Sengkang GRC has been referred to the Committee of Privileges for breach of parliamentary privilege.

The Workers' Party disciplinary panel comprises secretary-general Pritam Singh, chair Sylvia Lim and vice-chair Faisal Manap.

The panel will report its findings and recommendations to the party's central executive committee after it completes its work, said the Workers' Party.

"The work of the Party's Disciplinary Panel is separate from any decision the Committee of Privileges of Parliament may make," it added.

CLAIMS OF POLICE MISHANDLING​

Ms Khan first mentioned the rape case on Aug 3, during a Workers' Party motion on empowering women.

She said she had accompanied a 25-year-old woman to make a police report three years ago, and that the victim had come out crying because a police officer allegedly made comments about her dressing and the fact that she had been drinking.

The allegations prompted Law and Home Affairs Minister K Shanmugam to ask for more details of the case in Parliament, as well as an investigation by the Singapore Police Force.

In Parliament on Monday, Ms Khan admitted that she was "not present with the survivor in the police station as I described".

She said the anecdote was shared by a survivor in a women's support group that Ms Khan was part of.

"I did not share that I was a part of the group as I did not have the courage to publicly admit that I was a part of it," she said.

Ms Khan revealed that she was sexually assaulted when she was an 18-year-old studying abroad, and that it has traumatised her until today.

She apologised to the sexual assault victim in the case she brought up, saying she should not have shared it without her consent.

"As a survivor myself, I feel this failure deeply. It is important for me to take responsibility for my actions, for my error of judgment and to set the record straight," she said.

In referring Ms Khan to the Committee of Privileges, Leader of the House Indranee Rajah noted that she had lied in Parliament on three occasions and failed to substantiate the allegations.

Mr Singh earlier said on Monday that Ms Khan should not have shared in the House an account that contained untruths.

He noted that the Parliament (Privileges, Immunities and Powers) Act gives an MP "significant freedom of speech", but that this "does not extend to communicating untruthful accounts, even if an MP's motives are not malicious".
