Man jailed, caned for molesting niece

SINGAPORE: A man felt his brother and sister-in-law caused him to be homeless and he took revenge on them by outraging their daughter's modesty.
The 28-year-old unemployed man was sentenced to four years and 11 months' jail for the aggravated outrage of modesty of his 13-year-old niece.
The court has also ordered him to be caned six strokes.
The incident occurred on June 22, 2011 at about 1.30pm in the male toilet of Fort Canning Park.
Earlier that day, the victim was having lunch with her mother and brother at Orchard Cineleisure.
The accused lied to his niece to get her away from her mother and brother while they went to the toilet.
He pretended that police officers were chasing after him and asked the victim to run.
The accused subsequently brought the victim to Fort Canning Park and told her he needed the men's room.
Thereafter, he pulled the victim into the toilet with him and made her take her clothes off.
Court documents stated that the accused tried penetrating her but stopped short of rape.
The victim's ordeal eased when she asked why her uncle was doing this to her when he had said previously she was like his daughter.
The accused stopped and the victim took the opportunity to escape and contacted her mother.
In submissions, the prosecution asked for a tougher sentence as the accused abused his position of trust as the victim's uncle.
They added that the offence was committed in an especially reprehensible manner and that the accused threatened the victim twice in getting her to cooperate.
Court documents state the victim is now deeply traumatised and undergoing counselling. The accused also admitted to a charge of snatch theft committed on June 18, 2011 at Bukit Batok East.
For this charge, he was given a jail term of 15 months.
