Lounge patron admits to using ice-pick to stab man

IT STARTED off with a quarrel over a billiard cue hitting a beer jug in a karaoke lounge and ended with a patron stabbed to death with an ice-pick in the car park.

On Tuesday, David How Kim Fwee, 64, pleaded guilty to committing culpable homicide and causing the death of Mr Sim Kim Hock in the early hours of Oct 14 two years ago. He will be sentenced on Tuesday.


The High Court heard that the killing took place in a multi-storey car park outside the Grand City KTV & Lounge on the fifth floor of the City Plaza mall in Geylang.

Both men were regulars at the lounge. On that evening, Mr Sim, 46, a manager of an entertainment business, was there with store assistant Raymond Ong Sim Eng and several friends.

At 1am, Mr Ong, 38, and How were playing billiards when the latter's cue bumped into the beer jug that Mr Sim was holding. An argument broke out but Mr Ong convinced How to resume playing.


However once the game was over, he helped himself to an ice-pick from the bar counter. Tucking it in the back of his pants, he waited in the car park.

The lounge manager, Ms Kaina Koh Chen Yee, 32, went after him but failed to persuade him to hand over the ice-pick.

Instead, he started complaining about Mr Sim's attitude over the beer jug incident earlier. Some 30 minutes later, Mr Sim stepped outside to use the washroom. He confronted the older man, who was still grumbling.

A fight broke out and Mr Sim was stabbed five times with the ice-pick, once through the heart.


In October 2009 when How was charged with murder, he appeared in court with a black eye and bruises on his head. The charge was later reduced to culpable homicide after defence counsel Subhas Anandan and Sunil Sudheesan informed the Attorney-General's Chambers that there could be some element of provocation.

SINGAPORE: A businessman who plunged an ice pick into the heart of another patron at a karaoke lounge in Geylang in 2009 pleaded guilty to culpable homicide on Tuesday.

On Oct 14 that year, David How Kim Fwee, 64, and Sim Kim Hock, 46, were playing billiards with friends at the Grand City KTV and Lounge in City Plaza. An argument broke out after Sim's billiard cue hit How's beer jug as he was pouring beer from it.

After the argument, How asked the KTV manageress for a penknife. When she refused, he took a 22cm-long ice pick from a beer bucket at the bar counter. He hid the ice pick under his shirt and went to the carpark outside the KTV between 2am and 2.30am.

Both How and Sim met again at the carpark later. Sim heard How complaining and approached him, leading to another round of argument followed by a fight.

That was when How used the ice pick to stab Sim in the left chest. Sim collapsed and How continued to stab him. A customer and How's friends tried to stop him. How then drove off, leaving the ice pick behind.

The events that led to Sim's death were presented by Deputy Public Prosecutor Gordon Oh to the High Court on Tuesday, along with an autopsy report which detailed the five stab wounds on Sim's body - including a fatal jab of about 17cm long - that penetrated his heart.

How's lawyers, Mr Subhas Anandan and Mr Sunil Sudheesan, requested for an adjournment to allow the defence to prepare its mitigation. The case will be heard again next Tuesday.

The penalty for culpable homicide not amounting to murder is life imprisonment or a jail term of up to 20 years and may also include a fine or caning.

A 64-YEAR-OLD man was jailed for seven years on Tuesday for fatally stabbing a 46-year-old man with an ice-pick on July 26 following a quarrel over a billiard cue hitting a beer jug.

Businessman David How Kim Fwee had pleaded guilty to culpable homicide last week. He admitted killing Mr Sim Kim Hock, 46, in the early hours of Oct 14 2009 at a carpark outside the Grand City KTV & Lounge in City Plaza mall in Geylang.

In sentencing, High Court judge Chan Seng Onn said this was an unfortunate case arising out of a small matter that escalated to the point where How used an ice-pick to stab Mr Sim. Justice Chan also noted that How was an elderly man and a 'crushing sentence' was not necessary in this case.

Mr Sim, a manager of an entertainment business, visited the lounge with store assistant Raymond Ong Sim Eng, 38, and several friends.

Mr Ong and How were playing billiards when How's cue hit the beer jug Mr Sim was holding. Words were exchanged.

When the game ended, How picked up an ice pick from the bar counter, which he eventually used to stab Mr Sim to death at the carpark outside the lounge.

Mr Ong and two others drove Mr Sim to Changi General Hospital, but the injured man died within 15 minutes.

This is an unusual case and AG has to explain on what grounds he was spared the gallows. By picking up and keeping it despite being approached by staff. It has all the ingredients of pre-mediation. He waited for the victim with the ice-pick. So the argument of a sudden fight and provocation does not apply.
