Indian Man accused of Raping a Dog

This the first of its kind case in India in which a crime against an animal is being treated on par with a crime against humans, the prosecution is going to tenuous lengths to prove the rape of a dog.

A 26-year-old taxi driver from Mumbai, charged with having sexual intercourse with a dog, told a sessions court that he should be given bail because the police was not in a position to record the victim’s statement.

Mahesh Kamat was arrested from Tardeo on August 30 and booked under section 377 of the Indian Penal Code (IPC). It deals with offences relating to ‘‘unnatural sex’’; cops also slapped him with the Prevention of Cruelty to Animals (PCA) Act. However, Kamat — in custody since his arrest — pleaded that the PCA was not applicable to him as the dog he was charged of having intercourse with was a ‘‘stray’’ and not a ‘‘pet dog’’. He also said that he had been falsely implicated in the case.

The court though turned down the plea saying there was enough evidence against him. Moreover, it said that Kamat’s alleged offence had disturbed the residents of the area and the act amounted to cruelty to an animal.

Path-breaking steps are being taken like semen samples, injury marks and dog's hair in the nails of the suspect, used in patently non-consensual sex. This case is being seen to bring in a historic change when Section 377 of the Indian penal code would be used to punish people for unnatural sex. However the case of stray dog in Tardeo, which was allegedly raped by a taxi driver, shows how the authorities are still unclear how to handle such incidents. On the first night, the police were not sure if they should lodge the case and find a section to charge the accused.

Mumbai: In a shocking revelation, a 35 year-old man, Mahesh Kamat, was caught raping a stray-bitch. The incident was reported in the media by an eyewitness who had the video byte of the eye witness.

The police has slapped IPC Section 377 (against the order of nature) on the man and booked him for unnatural sex. Speaking on the issue the bemused policeman said that he hasn’t encountered a single case as this in his 30 years of service.

The police has sent the clothes of the culprit to the forensic lab. The medical has been done and the police is awaiting the report. However, since the eyewitness has testified and caught the man red-handed in the act, an FIR (First Information Report) was lodged.
The policeman, however, maintained that the man isn’t mentally unstable, and has confessed to the crime. The man has stated ‘missing his wife’ as the reason for committing such shameful act. Apparently, the man’s pregnant wife has gone back to her village for the pregnancy period.
The victim of molestation (bitch) has virtually undergone a hunger strike and is in a state of shock.
The issue has also sparked another debate in the blogging world that whether or not the guy’s act should be considered as a crime.
“Since the bitch is stray and no one holds rights over her, the ground on which his act shouldn’t be considered as a crime is debatable; after all it all depends on what rights you want to give to the bitch,” says one such blogger.
“The section 377 already violates the article 14 of the Indian Constitution. Anyone’s sexual preference is his/her personal choice,” writes another.
That’s another aspect to think about. Are the Animal and Human Rights activists reading this piece of news?

A taxi driver named Mahesh Kamat was found in the compound of a housing society in an inebriated state and with his trousers unzipped and when the police arrived he was being beaten by a group of people from the society who claimed that he had raped a bitch.
Then next day he, however, kept repeating that he did not recollect what happened that night.
"I have not done anything. I don't remember anything because I was not in my senses," said Kamath. Neither did he remember being beaten by residents of the building (maybe they did not beat him enough).
However, in a statement to the police the previous night, Mahesh had allegedly admitted saying, "Haan, maine kiya hai" which sounds perfectly plausible as the drunk would have probably not known what was being asked of him least of all known that he was being accused of copulating with a bitch.
According to the police he is said to have replied (with the now famous words) 'Hogaya, hogaya' (happened, happened) when asked why he raped the bitch. Now the police (who I had no idea had so much time and resources on their hands) have sent the clothes he wore that night to the forensic laboratory and are waiting for his medical reports
The victim's testimony is usually crucial in such cases, but there is naturally no chance of recording the dog's statement.
Meanwhile the stray dog raped by Kamath is supposed to be traumatised. According to Sangeeta M Revdekar, the second eyewitness in the case, "The dog has been listless since the incident took place and is neither eating food nor sitting outside our house like she usually does."

Now that its in the open, the least Mr.Mahesh Kamat should do is, marry the victim. There must be some 'love' or sexual attraction, between him and the victim.

i think it will be difficult for the the prosecution to prove that the canine has not consented!:wink: wahhahahhhaa...........
