獸父自殘作要脅 8年內月姦親女兩次判囚11年半

【星島日報報道】53歲輕型貨車司機從其親生女兒僅12歲開始，8年內每隔一至兩星期，當妻子晚上外出兼職時便強姦女兒，期間要求女兒陪他觀看色情影片，甚至要求女兒模仿片中女子的姿勢。女兒於2016年從澳洲完成工作假期後返港，父親要求舔女兒私處被拒，更威脅女兒稱他會自殺或殺害她的男友。母親及女兒數天後發現家中菜刀不翼而飛，擔心他圖謀傷人而報警。男司機早前承認9項強姦罪，今於高院被判11年半。
暫委法官潘兆童表示，今次案件的情節嚴重，被告視親生女兒為洩慾工具，而受害女兒則由12歲開始遭性侵，被告則利用父親的身份及權力犯案，實在可恥。加上女兒回港後，被告仍然脅迫她，行為「卑劣不堪」，女兒亦因事件而有創傷後遺症，故最終判以11年半。
辯方今於庭上呈上受害女兒的求情信，指她於信內表示難以面對被告，但希望往後可與家人有健康的家庭生活，而兒子亦有撰信表示被告平日和藹可親，難以相信他會作岀如此行為。
然而，被告一早認罪，令受害女兒無須岀庭作供，另外，被告犯案時未有使用暴力，而是以自殘的方式迫使受害人就範。辯方續指，明白被告今次的行為於法律及道德上難以接受，然而被告已理解事件的嚴重性及表達其真實的悔意，望法官可酌情輕判。

The Singtao Daily reported that the 53-year-old LGV driver started from his biological daughter only when he was only 12 years old. Every 1-2 weeks within 8 years when his wife went out for part-time work at night, she raped her daughter and asked her daughter to accompany him to watch pornographic videos and even asked her daughter. Pan Zhaotong, a deputy judge, said that the circumstances of the case were serious. The defendant saw his daughter as a tool for liberation, and the victim’s daughter was sexually assaulted from the age of 12. The defendant used his father’s identity and power to commit crimes. This is shameful. After adding her daughter back to Hong Kong, the defendant still coerced her and the act was “despicable”. Her daughter also suffered traumatic sequelae because of the incident. She was eventually sentenced to 11 and a half years.
The defense case presented a letter of approval for the victim’s daughter in court. She said that in her letter, she stated that she could not face the defendant, but she hoped that she would be able to have a healthy family life with her family. The son also wrote a letter saying that the defendant was affable on weekdays. It was difficult. I believe he will do so.
However, the defendant pleaded guilty in the early morning so that the victim’s daughter did not need to give a court testimony. In addition, the defendant did not use violence when committing the crime. Instead, he forced the victim to submit himself in a self-harming manner. The defendant continued to point out that it is difficult for the defendant to accept this act legally and morally. However, the defendant has understood the seriousness of the incident and expressed his genuine remorse. The judge is therefore in a position to judge lightly.
