【星島日報報道】裝修工人涉於去年10月在高等法院以菜刀威嚇法官陳嘉信，及疑用刀劈向法官席前的桌子，涉案裝修工否認刑事毀壞罪、刑事恐嚇及管有攻擊性武器共3罪，案件今於區域法院開審。控方陳詞指，被告於警誡下稱當日收到上判案書感到受屈，欲向申索初審時判他敗訴的陳官發洩冤屈，認為判決不公道，所以生他的氣。
53歲被告余祖林今未有律師代表，控方陳詞時指，被告於2011年的傷亡訴訟中聲稱3名警員在2008年對他執行拘捕行動使他受傷，要求索償66萬賠償，惟其申索最終被駁回，他不服判決提岀上訴，並且得直，但該案重審後，他的申索再被駁回，遂他在去年再次申請上訴許可。
於去年10月17日約9時許，被告先到達法院3樓，以等候上訴庭頒下判案書，期間他從背囊取岀原放在透明膠殼的菜刀揮舞一番，再放回膠殻以及背囊內。其後他得悉申請上訴失敗，遂他往地下大堂查看審訊案件表，再往7樓。
當時陳官正宣讀另一宗案件的判決，被告則坐於公眾席，並從背囊取岀長12吋的菜刀。然而法庭書記喝止，被告仍把菜刀從膠殻掏岀，並向法官席前行前數步，以普通話向陳官叫喊，內有意思包括「陳嘉信，我找到你，我斬死你」。被告當時激動及將菜刀舉至頭部，而他與陳官距離約2至3米，書記及陳官隨後立即由法官通道離開法庭。
被告站於法官長檯左邊揮動菜刀數次，再以普通話說些話，包括「陳嘉信，你以為我找不到你？」。期間，被告在法官檯上又敲打兩下，致檯上有一道約5厘米的切割痕，並留下膠殼，被告近10時則離開法院。

法官蘇文隆甫開庭時向被告表示自己認識陳嘉信法官，但並非其友人，「我冇佢手提電話，我從來冇同佢講過電話」，陳的官階亦比他高，兩人會在開會和上堂時見面。蘇官續稱，「入咗法律界廿幾年，我冇試過同佢同檯食飯」，又認為依據本港司法編制，若果要安排一位與他完全陌生的法官處理案件是不可能，被告聽畢即回應指「我相信這位法官」。
控方一度在庭上申請修改控罪，要求將涉案範圍由高等法院7樓13庭擴大至整座法院大樓，並指錄影拍到被告曾於法院大堂揮舞菜刀，疑正作預備及「綵排」。但被告反對申請，聲稱自己是用刀「磨脖子、割手腕」，又解釋「要自殺死在他（陳官）面前」。蘇官表示擴大控罪範圍可能會對被告不公，最後拒絕控方申請。
