Before the Cahors criminal court, a 22-year-old young man appeared at the end of April, prosecuted for sexual assault on a 9-year-old minor and for possession of child pornography images.
The facts date back to April 24, 2020, in Cahors. A child is playing in front of a building in Terre Rouge, a neighborhood where this man, born in Iran, of Afghan nationality, lives in social housing. Looking for the football field, the little boy agrees to follow the individual.
In front of the field, he asks him: “Show me your penis,” promising in return a game console. The child accepts, then changes his mind: “No, I don’t want to.”
The man then takes his penis out of his shorts and asks the little one to masturbate him. The child obeys and later tells the investigators: “I had a very strong heartbeat.”
Meanwhile, the father of the child has noticed his disappearance and goes looking for him, before finding him. In the evening, the child confides in his mother, who will file a complaint the next day.
At the hearing, the alleged perpetrator, assisted by an interpreter, spoke of scheming and blackmail: “If you give me €10,000, I won’t go to the police,” the boy’s mother allegedly told him.
The investigation reveals the complex migratory journey of the young man, whose asylum request was rejected by the Ofpra and who was expelled from Sweden. The search of his residence makes it possible to find the shorts, which reveal traces of sperm and DNA. Then, the examination of his mobile phone found 71 child pornography files featuring little boys.
This migrant denies everything: the forced masturbation and having presented these photos to the child, who nevertheless maintains the accusation: “He showed me disgusting images.”
The alleged perpetrator adds: “I have a sister and a brother in Afghanistan who are the age of the child. I would never have done that.” His psychiatric examination revealed no psychiatric pathology.
The young victim, represented by the UDAF ad hoc administrator, reports a post-traumatic emotional shock, with a feeling of guilt and shame. His lawyer, Me Alexopoulos, requested €2,000 in damages.
As for the prosecutor, she demands 5 years in prison, including 3 years required against the defendant, and asks the court to consider the advisability of a warrant of committal at the hearing, a ban on entering French territory for 10 years, and registration in the FJAIS (file of perpetrators of sexual offenses).
The man, who has already served 1 year in prison after the fact, no longer has a home. He sleeps on the street or calls 115.
His lawyer, Me Belou, wonders about the requirements and pleads: “We fear that he will disappear in the wild… He could have not come. However, he is here, he appears before his judges to say what he has to say, to take responsibility.”
And again “He comes from a country where there is no sexual majority. You have to take into account the cultural difference, the psychological background. Where he comes from, pornographic images on cell phones are common. He comes from this chaos which is that of his country.” “If you follow the requirements of the prosecution, he will have to return to Afghanistan, and this is the main sanction of the case.”
The defendant cries hot tears: “My life is already destroyed.”
The court found him guilty, sentenced him to 30 months in prison, ordered immediate imprisonment, then banned from returning to the national territory, and from carrying out any activity related to minors. The court also ordered his registration with the FJAIS and the payment of €2,000 to the civil party for non-pecuniary damage.
