Dear Brothers,

I resigned from my job recently and I had accumulated a good number of days of leave. but my last pay chk the company forfeited my leave.

Is it legal? and recourse?

u r entitled to ur leave...why did u factor them in when serving ur 1 or 2 mths notice?
Ask ur HR abt it...if they refuse to pay u...u can try MOM...

What a funny question. If you are not covered by the Employment Act, the only law governing your employment is the law of contract i.e. what you agreed upon in the employment contract. If your employment contract says unused leaves will be forfeited, then they are forfeited without any recourse to you.

I vet thru the entire contract, they is no clause regarding forfeiture upon resignation.. they forfeit my normal leave not sick leave.. I have balance of 8 days leave.

My salary is above 2.5K so does that means I do not come under MOM jurisdiction?

Typically, most companies would use the unconsumed annual leave to offset the resignation period. Check your notice period as per your employment contract and compare that against your notice period on your resignation letter and the period served after tendering.

MOM would not cover anything above 2.4K if I remember correctly.

Contact your HR and ask for an appointment to clarify. Clarify your doubts in person and if they still play punk, consult a lawyer.

8 days of 2500,,,,, $800,,,,, 8 days annual leave, all depends on employment contract, have given enough termination notice, did HR indicate you still have 8 days outstanding leave etc etc,,,,,

try and claim, if not, sweet talk to HR and see,,,,,, leaving the job on a good or sour note?
