Embezzlement and bribery with government money are among the charges that the government is looking to bring against former prime minister Najib Abdul Razak following a probe into funds allegedly looted from the state-run fund 1MDB, Prime Minister Mahathir Mohamad said on Tuesday.

Mahathir told Reuters in an interview that investigators already “have an almost perfect case” against the principal suspects who had defrauded 1MDB and misappropriated billions of dollars in public funds.

He also described Najib, who had founded 1MDB, as playing a central role.

“He was totally responsible for 1MDB. Nothing can be done without his signature, and we have his signature on all the deals entered into by 1MDB. Therefore, he is responsible,” Mahathir said.

Having retired as prime minister in 2003 after 22 years in power, Mahathir – who is aged 92 – came out of retirement and joined the opposition to topple Najib in an election last month.

Following his stunning victory, Mahathir has reopened investigations into 1MDB and Najib’s involvement in its operations.

As a result of an anti-kleptocracy probe, the US Department of Justice has alleged more than US$4.5 billion was misappropriated from 1MDB, and that about US$700 million of that ended up in Najib’s personal bank accounts.

Mahathir has barred Najib from leaving Malaysia, and police have searched properties linked to him, while anti-graft investigators have questioned both Najib and his wife, Rosmah Mansor.

Najib has consistently denied any wrongdoing, and repeated last week that he did not take money from 1MDB.

His spokesperson could not immediately be reached for comment on Tuesday.

'Rosmah also being investigated'

Investigators are looking to bring “a number of charges” against Najib, Mahathir said, adding those charges would be based on abuse of power when he was prime minister.

They could include “embezzlement, stealing government money, losing government money and a number of other charges. Using government money to bribe. All those things,” he said.

Mahathir said Rosmah was also being investigated in connection with 1MDB.

“Some of the money is believed to have gone to her, lots of money,” Mahathir said. “We know about this, but finding the paper trail is a bit more difficult in this case because she doesn’t sign any papers. Najib signs a lot of papers.”

Mahathir said he expected Malaysia to make its first arrest in the 1MDB case within months and “hopefully” start a trial by the end of the year.

“We are working as hard as possible at a furious pace. We think that we already have almost a perfect case,” Mahathir said.

Asked to name the targets of that case, he said, “Against Najib, against Jho Low and a few others.”

Low is a Malaysian financier, who is also seen as a central figure in the 1MDB scandal. He is regarded as close to Najib and his family.

Low’s lawyer could not be immediately reached for comment.

“When we go to the courts, we will have clear evidence of the wrongdoing. We cannot afford to lose,” said Mahathir.

KUALA LUMPUR: The father of murdered Mongolian model Àltantuya Shaariibuu lodged a police report on Wednesday (Jun 20) to jump start the process of reopening investigations into the case, nearly 12 years after she was killed in Malaysia.

Malaysian Prime Minister Dr Mahathir Mohamad received Shaariibuu at his office later on Wednesday evening and indicated that he would support the reopening of the investigation into Altantuya’s murder if the evidence is there.

“He (Mahathir) is for the investigations reopening if there is new evidence … as long as it is in accordance with the law, which is correct. We agree with that,” Ramkarpal Singh, lawyer for Altantuya’s father, told Channel NewsAsia after the closed-door meeting.

Ramkarpal said Shaariibuu was “very satisfied and very happy with the meeting” and thanked Mahathir for seeing him.

On Tuesday, Shaariibuu said the previous government tried everything to prevent the truth from emerging.

FORMER AIDE OF EX PRIME MINISTER NAJIB RAZAK A CRUCIAL WITNESS

Earlier on Wednesday morning, Setev Shaariibuu turned up at the Dang Wangi police station in Kuala Lumpur accompanied by his lawyer Ramkarpal and filed a police report where he named a former aide-de-camp for ex-prime minister Najib Razak as a "crucial witness" in the case."

"Musa Safri, he is ... a very crucial witness. He is important because according to the prosecution's criminal case, he played a very significant role," lawyer Ramkarpal Singh told reporters outside the police station.

“He (Musa Safri) should be called up to explain what the role was," he added. “Why did the prosecution not call him in the past? It's a glaring omission on his (prosecutor's) part. This is something the police must take into account."

Shaariibuu said he believes that if it was not for Musa Safri, Altantuya's killers would not have "taken my daughter away".

The police report filed on Wednesday is the first step in reopening the case, said Ramakarpal. "I think there is a very good chance of that happening within the next three to four months," he added.

Altantuya, 28, was shot dead and her body blown up by military-grade C4 explosives in Shah Alam in 2006.

She had been forcibly taken from outside the home of her alleged lover Abdul Razak Baginda - a defence analyst who advised Mr Najib between 2000 and 2008 when he was defence minister.

Two policemen, Sirul Azhar Umar and Azilah Hadri, who were Mr Najib's former bodyguards, were found guilty and sentenced to death in 2015 for her murder.

Razak was charged with abetment in the murder, but was freed.

MUSA SAFRI ALLEGEDLY INTRODUCED ALTANTUYA’S LOVER TO THE POLICEMEN WHO KILLED HER

Musa Safri was named as the person who introduced the two policemen to Razak, according to a civil suit filed by Altantuya’s father Shaariibuu in 2007 against Razak.

The Malaysian Insight news portal reported on Wednesday that during Altantuya's murder trial, Musa was not on the witness list despite allegedly being the go-between for Razak and the former policemen who murdered her.

Altantuya’s father said in his police report that Musa “secured the attendance” of the two cops at Razak’s house on the night she was taken away.

“I further note that during the said trial, the prosecution led evidence that one Musa Safri had secured the attendance of Azilah and Sirul at Razak’s house on the night of Oct 19, 2006,” said Shaariibuu in the police report.

“As such, I believe that if not for Musa, Azilah and Sirul would not have come to Razak’s house that day and taken my daughter away and she would very likely still be alive today.

“Musa therefore is a very crucial witness as he would be able to provide information as to who instructed him to secure Azilah and Sirul’s said attendance and for what purpose,” said Shaariibuu.

“Throughout the murder trial, no evidence was led by the prosecution as to who ordered my daughter’s murder or the motive behind it although I believe that this was relevant to the case,” Shaariibuu added.

Convicted cop Azilah is currently on death row at Kajang prison, while Sirul fled to Australia before sentencing and is now held in an Australian immigration detention centre.

Shaariibuu added that he believes both Azilah and Sirul had no motive to kill his daughter as they did not know her prior to the murder.

He also urged the police to investigate the supplier of the explosives that were used to blow up his daughter's body.

“I also believe that my daughter’s body was blown up to pieces by the use of explosives and urge the police to properly investigate from where Azilah and Sirul obtained such explosives which I believe can provide clues as to whether the party or parties who provided them with those explosives had an involvement in my daughter’s murder,” he said.
