ARREST ISSUE OF ONG SING YEE WHO WAS INVOLVED IN THE STOMPING OF PICTURES OF PM NAJIB AND HIS WIFE, ROSMAH - NORMAN FERNANDEZ

On Wednesday September 5, I accompanied a 19 year old teenager Ong Sing Yee to the Johor Bahru Central Police Station. She had earlier seen her photo and read in the China Press that the police were looking for a number of people including her to assist the police who were investigating an incident at Dataran Merdeka on the night of Merdeka, where apparently some people had stepped on the photos of Prime Minister Najib Tun Razak and his wife Rosmah Mansor.

At the Johor Bahru Central police station, and where the initial questioning took place, I must acknowledge that the police treated her with decorum and professionalism. The police officer questioning her even asked me to buy her food and drinks. After her statement was taken, the police informed her that she is being investigated for committing an offence under s.4(1) of the Sedition Act and she was going to be brought to Kuala Lumpur for further investigation. I had earlier told her that she must be prepared for that the police will take her to Kuala Lumpur for further investigation. The police officers did inform her and me, that they will before taking her to Kuala Lumpur go to her house to retrieve the T-Shirt which she had worn during the night of the incident.

It has now come to my knowledge that, prior to taking her to Kuala Lumpur, she was then taken to the Johor Police Headquarters where she was further questioned and this time without the presence of any lawyer. Ong Sing Yee hardly can speak a word of Malay or English. Apparently a statement was taken where she was being held at the Johor Police Headquarters, a police interpreter then translated her statement and she was asked signed her statement which she did. She certainly never had the opportunity to verify independently if her whole statement was translated to her or even accurately translated or the statement contained information which she had never said and those statements not read back to her. I stand corrected on this issue.

Ong Sing Yee is now being investigated under s.4 of the Sedition Act 1948. Under s.4, it is an offence for any person who does or attempt to any act which has or would have a seditious tendency. Ong Sing Yee’s case, could a Malaysian first, where stepping on the prime minister photo and even worst his wife can now tantamount to a seditious act. Mischief making? Probably. Sedition? Surely not!

Nevertheless, it is agreeable that it is bad manners and uncouth behaviour to step on one’s photograph although it’s becoming the norm now days in Malaysia. No one condones what she did but the question is why only her and why only now. We have witnessed army personnel doing “butt exercise” against Ambiga. The Chief Minister of Penang Lim Guan Eng, his photo is trampled ever so regularly and there was an incident of some youths urinating on Tuan Guru Nik Aziz’s poster. Going by the police’s exuberance in charging Ong Sing Yee with committing sedition, surely the police must arrest and charge the perpetrators who did the same to Ambiga, Lim Guan Eng or Tuan Guru Nik Aziz. Or is it a case of different rules applying for different people.

Ong Sing Yee may have her own reasons who she stepped of the Prime Minister and Rosmah Mansor’s photos, but she has now apologised to the Malaysian public. Thus, it’s time that the police discontinue further investigation on Ong Sing Yee. To pursue a case against Ong Sing Yee but being indifferent on cases involving people like Ambiga, Lim Guan Eng or Tuan Guru Nik Aziz would simply be construed as a case of vindictiveness, persecution and double standard.

Surely, the police can be forgiving and magnanimous and with Ong Sing Yee now having made an open apology to all Malaysians, which also includes the prime Minister and his wife,

Let the Malaysian public see this magnanimous side of the police.

KUALA LUMPUR: A teenager today apologised for stepping on the prime minister’s picture at Dataran Merdeka during the countdown of the country’s 55th National Day last week.

Ong Sing Yee, 19, had surrendered to the police in Johor yesterday to help in investigations over the incident.

"I apologise for my stepping on the prime minister’s picture at Dataran Merdeka," she said at a press conference at the DAP headquarters here.

She said she had only followed suit when she saw others doing the same.

"Here, I would like to say sorry to everyone," Ong said.

Her lawyer Eric Tan, who was also present at the press conference, said that she did it "unintentionally" and without realising it could be construed as seditious.

"Now knowing this has become an issue and especially [since] it could be investigated under [the] Sedition Act, she apologised and she emphasised that she wasn’t intentional on doing that."

"She said very clearly that she did not intend to conduct any seditious act," Tan said. "I think she has no actual intention to humiliate the PM."

Tan added that Ong was informed that she was being investigated under the Sedition Act.

But he also said there was "double standards" at play, asking why police had not investigated similar incidents involving the pictures of the Penang chief minister and Kelantan mentri besar under the Sedition Act.

Last Thursday, several individuals were recorded tearing up posters with the images of the prime minister, his wife and Election Commission chairman Tan Sri Abdul Aziz Mohd Yusof at Dataran Merdeka.

A few individuals were also spotted waving a pre-independence flag, the Sang Saka Malaya, instead of the national flag, which Umno later blamed on the federal opposition Pakatan Rakyat (PR).

Bukit Aman’s CID director Datuk Seri Mohd Bakri Zinin had on Monday told The Malaysian Insider that the police were probing the two separate incidents under the Sedition Act ― despite Putrajaya’s decision to repeal the controversial law that has been widely panned as a tool to curb political dissent.

He added that stepping on pictures of Najib and wife were considered offences under Sections 290 and 504 of the Penal Code for being public nuisances and intentionally causing insult with intent to provoke a breach of the public peace, respectively.

Those convicted under Section 290 may be fined up to RM400 while those found guilty under Section 504 can be jailed up to two years or fined, or both.

By now, the above picture has gone viral on the internet showing 19-year Ong Sing Yee being led away in handcuffs at the Johore Bahru Central police station, for allegedly stamping on the pictures of Najib and Rosmah. However, the point here is not whether Miss Ong was guilty of the act or otherwise, but the question on everyone's mind is, were the handcuffs necessary. After all, she gave herself up and I doubt she had any intention of making a quick getaway after presenting herself to the police. The picture of her being handcuffed will certainly be etched in the minds of many people for some time to come as it sent out the wrong message of the might of the PDRM [read UMNO] vs a helpless teenager, and for this mis-step, it will further erode UMNO's vote bank in the coming GE, as people will start to compare why no actions were taken against the culprits who committed similar offence or worse.

Strange as it may seems, the police do not seem bothered looking for these people who committed these uncoathed acts. When it involves other members of the rakyat, the police will always end up issuing a statements that "they are looking for so and so ....." and that they know who the culprits are from the photos posted on the internet and the msm. Why don't they do the same with those from UMNO and PERKASA?

It was almost laughable when I read that they initially wanted to charge Miss Ong under the Sedition Act. The question that came to my mind was, was she a threat to national security? Her act may seem distasteful and could only be considered a misdemeanour. For this, they wanted to apply the Sedition Act? It really tanatamounts to using a sledgehammer on a fly. If the Sedition Act needs to be applied, then they should have looked into the following case involving UMNO members.

The (in)justice meted out to ordinary citizens have become blatantly clear that there are two sets of rules. One for BN and the other, for non-BN.

Ms Ong Sing Yee may not know it yet, but this pint sized teenager could probably be the one to finally topple the BN government come GE13.

Of course it was normal police procedure to handcuff those suspected of committing a criminal offense. But really la, how can these evil mat mata-mata handcuff such a sweet and innocent looking Chinese girl. So evil la these people....

Police to review use of handcuffs, says CID director Bakri Zinin

KUALA LUMPUR: Police will review the standard operating procedures on the use of handcuffs.

Federal CID director Comm Datuk Seri Mohd Bakri Zinin said this follows complaints on the use of handcuffs in recent cases.

"We will be studying the use of handcuffs to ensure they are used when necessary," he told reporters at Bukit Aman.

Home Minister Datuk Seri Hishammuddin Hussein recently said a review of the police's procedures when detaining those who surrender themselves was necessay.

His comments came after the handcuffing of Ong Sing Yee, 19, when she turned herself in for stepping on a photograph of Prime Minister Datuk Seri Najib Tun Razak at the Merdeka eve gathering.

On another matter, Bakri said police have identified a suspect involved in throwing red paint on a bus used by PKR for its Jelajah Merdeka Rakyat in Jasin, Malacca.

"We are looking for the man but it is better if he surrenders himself as soon as possible," he said dismissing allegations that police were turning a blind eye to reports lodged by the opposition.

i agree that its bumiputra shit in malaysia where the chinese and indians are waived off. i have spoken to friends personally from there of both races and they shared stories with me.
