SEREMBAN: THE case of a woman suing her father, a millionaire LBJ Felda settler, over his property will be heard next month.
Syariah High Court judge Kamal Basha Muhammad postponed the case to Oct 12 to allow the plaintiff, Nozay Rashid, 44, to call witnesses to support her demand.
Nozay, the sixth of seven children of Rashid Jani, filed the suit against her father on February.
In her claim, she had asked the court to declare that half of a RM160,000 plot of land belonging to 75-year-old Rashid was a property jointly obtained with her late mother, Kering Aman, during their marriage.
She also applied for her mother's name to be registered as a joint owner and that her share be divided among the heirs. The plaintiff claimed that her parents were married in 1953 and they had six daughters and a son, aged between 40 and 57.
Following the death of their mother in 2008, her father married a 33-year-old Thai woman in September 2009, and they were now living on the property with her two sons.
Nozay was represented by lawyer Maishiah Hassan while Rashid was represented by Hanif Hassan.
Rashid had filed his defence and made six counter claims. He claimed that his life was a mess following the death of his first wife.
Hanif said his client fell sick last year, but his children did not care for him, and the reason for him to sell the property was to pay for medical and daily expenses.
He said his client received RM1.6 million in 1998 after his 4ha land was acquired by the state.
Of this, his late wife received RM200,000 while each of his seven children received RM50,000 each. His counter claim had also demanded that the plaintiff return the RM50,000 as he was revoking it.
He was also claiming the right to properties owned by his late wife, such as the house now occupied by the plaintiff, the savings in her Tabung Haji account and jewellery, and that they be shared with the other children.
Rashid also demanded that Nozay provide him with RM1,000 in living expenses monthly for the rest of his life.
