网传:微信员工年终奖人均280万元?关于年终奖,看看法律怎么说!

前阵子,“微信员工年终奖为280万元”的传言在社交媒体广泛传播。
让全国上下网民们羡慕一片!
1月25日晚,微博认证用户腾讯公司公关总监@腾讯张军 发布微博回应称:
那么,一般公司的员工,年终奖能有多少呢?这里有一组数据。
智联招聘发布“2018太原白领年终奖调查”,数据显示,超四成的太原白领能拿到年终奖,平均值为4330元。
总体来看,2018年太原白领的年终奖平均值低于7100元的全国平均水平,但年终奖满意度为3.19,全国排名第13,高于全国平均值(3.13)。
有钱当然开心,没钱肯定很伤心,同时一定还会有很多员工有埋怨和疑问,今天小编为大家整理了《劳动法》对年终奖的规定:

年终奖应该怎么发?
很遗憾,在目前的《劳动法》中是没有关于年终奖的规定的。但年终奖应根据劳动合同的约定或者用人单位的规章制度来发。
年终奖是用人单位根据企业当年的效益为嘉奖有突出贡献和业绩的员工而发放的特殊薪资,奖金发放属于用人单位的自主权,单位可以自行决定发不发奖金、发奖金的条件和标准。
企业一贯的做法是,不在劳动合同中约定奖金的相关事项,或者是单独将年终奖规定在绩效考核制度中,也有些还单独制定有关年终奖的制度,甚至有部分用人单位没有任何规定。
这些方法确实可以加大用人单位支付年终奖的随意性,但要是有员工因年终奖的发放与公司产生纠纷后,用人单位要承担举证责任,那时候会比较麻烦。
所以一定要在劳动合同中约定奖金的相关事项。

公司有权随意扣发年终奖吗?
第一种情况是,劳动合同中(或者规章制度里)明确约定年终奖金属于劳动报酬的一部分,那么用人单位不能无故扣发员工的年终奖金。
第二种情况是,劳动合同和规章制度都没有提到年终奖金的话,就还是那句话:扣不扣、扣多少要看老板心情......

新进、离职员工当年可以拿到年终奖吗?
还是分两种情况:
第一种情况是,劳动合同或者规章制度中有规定:要拿到年终奖,员工当年度必须在公司工作期满三个月;员工在发年终奖日前提出辞职或者因过失、非过失解除劳动合同的,将不得享受年终奖……有诸如此类的规定,自然是拿不到的。
第二种情况是,劳动合同或者规章制度都未对年终奖有明确规定,就要按同工同酬原则,如果员工选择劳动仲裁,法院一般会支持离职职工/新进员工得到一定比例的年终奖。

米面油能作为年终奖吗?
当然不可以!!
年终奖属于劳动报酬的一部分,多数公司会采用货币形式及股票期权激励方法发放,也有单位采用发放汽车、房屋等有较大价值的财产形式。
而有的单位竟将大米、酱油、大葱等生活用品作为年终奖,这些应当属于福利待遇,在未征得劳动者同意的情况下,擅自将发放形式变更为以物折抵,或者发放网络内使用的虚拟货币,这种变更行为显然是无效的,不能随便糊弄员工哦~
关于年终奖,我们要学会维护自身和企业的合法权益,当然关键还是要按照《劳动法》来,所以了解《劳动法》中的一些规定,对于我们来说就很有必要啦!

话说,又到了一年一度的春节大假,相信电脑和手机前的你,早已是身在公司,心早已经飞到了家里了,对吧?你是不是还默默拉黑了盆友圈的好多晒土豪年终奖和年会的无耻童鞋?还有,你是不是天天都在做梦盼望着年终奖更高些?哼,不要否认嘛,说得就是你。
八姐也随机问了几个大互联网公司的童鞋,问问他们的年底福利到底咋样,嘿嘿,贴上来给大家看看。嗯,其实,你要是偷偷地作为年后跳槽的参考,我也并不介意哈。

员工A:我们还没发年终奖呢,应该是明天发。差不多平均每个人3-5个月吧。
员工B: 我们BG不算太多,但最基本也得有个两三个月的,我的同事有发六七个月年终奖的。微信支付团队和游戏的《王者荣耀》才是大赢家啊,不是听说微信支付300个员工就拿到了1亿元,平均每个人33万,而且,这还不是年终奖。。
阿里巴巴
员工小C:阿里年底双薪,现在不发年终奖,得等到4月份才发呢,年会也是那时开,所以,俺们部门即使有想离职的,也都得等到明年4月拿到年终奖后再撤。哈哈。
员工小D:阿里的年终奖是根据公司KPI和个人KPI综合打分的,区间3—4分,4分最高,但很少有人能达到,3.75分就是升职加薪和拿高额年终奖的分数了,3.5分是一般员工拿到的分数,分数3分基本就要被开掉了。去年,我的盆友在菜鸟评了3.75,差不多拿了7个月年终奖。我还有盆友因为去年余额宝业务不错,年终奖拿了16个月的薪水。

员工小F:我在大搜(搜索),我们今年的年终奖平均是两个月吧。百度是1-5分的打分,1分最高,平均员工是打3分的话,能拿到2个月工资的年终奖。但大搜今年的奖金可能总体不高,即便打了1分(最高了),因为系数比较低,最终也只能拿不到4个月的年终奖。虽然很多童鞋很郁闷,不过我觉得嘛,公司今年可能正在转型比较困难,可以理解,再说了,糯米什么的可能年终奖更低。当然啦,金融和无人驾驶什么的可能年终奖会多一些。

有人说是与河北的仓库被烧有关,一下烧掉了几十亿,虽然有保险,但貌似也难追回。当然了,公司10几万人呢,光年底接配送员家属过年也得花不少钱。但不得不说,京东的年终奖真的是太少了。

员工M:虽然我司以往是没有年终奖的,但今年老板一高兴,就在年会上给800个员工每人发了2.5万元。另外,我们是年底双薪+季度奖,嘿嘿,今年公司业绩不错,说不定季度奖也会很高的,这下可以安心过年了。

随后,腾讯张军辟谣,他表示人均280万那是不可能的,不过年终奖确实有增加。

年终奖人均280万是不可能的
不久后,腾讯公关总监张军辟谣:
“今天朋友圈里都在为#微信年终奖#操心。小伙伴立马去查银行卡了,哈哈。but,别激动,我要告诉大家的是,年终奖有增长是真,多少不知道,还没到发的时候呢。人均280万?那是不可能的,醒一醒!”
不过从张军的回应来看,微信年终奖确实是有增加的。
其实,一般情况下,为了激励员工,很多公司在年底都会以各种形式发放年终奖。
年终奖在不同的单位有不同的发放形式,除了一般意义上的“红包”外,有的是股票分红,有的是“双薪”,有的是提成,有的是奖金。
不过,今年许多人反映,本来就不透明的年终奖“跑得连影都没有了!”
智联招聘报告显示,参与调查的白领中有55.17%表示能拿到年终奖,比例较2017年的66.1%下降明显。2018年的全国白领年终奖总体均值为7100元。仅39.10%的白领的年终奖收入增加了,持平的为45.35%,减少的为15.55%。
而有些公司的年终奖让网友们直呼羡慕嫉妒恨!

据创业邦报道,美国电子烟公司Juul Labs拿出了20亿美元作为年终奖,1500员工平均每人能拿130万美元(折合人民币为895万元)。实际上,Juul Labs的电子烟在美国很受欢迎,毛利达到75%,市值已达380亿美元。

1、滴滴:取消高管年终奖,员工年终奖折半
据了解,滴滴2017年年终奖分ABC三档,A级别是6个月工资,B级别是4个月工资,C级别是2个月工资。有员工2017年到手的年终奖有四五万元。
而2018年的滴滴,一直在水逆。
据滴滴出行的财务数据显示,2018年上半年亏损急速扩大至40.4亿元,比2017年全年亏损的25亿元还要多出61%。2018年上半年滴滴的毛利率为1.6%,较2017年全年的1.9%下跌了0.3%。
在如此残酷冰冷的数据面前,2018年12月,滴滴CEO程维在全员大会上宣布“奖励”力度减半,而且高管集体不拿年终奖。
2、ofo负债累累,连工资都是问题
跟滴滴同样陷入水逆的公司,还有滴滴投资的ofo。
今年的ofo,已经从繁荣时的3400人裁减到如今约400人还在减少,戴威上了“限制消费令”白名单,不能坐飞机,不能坐高铁。提现困难、大裁员、负债等成为主旋律,别提年终奖了,ofo的员工可能连未来都不知道在哪里。
3、社交平台上,有京东、美团的员工在匿名吐槽年终奖缩水
2017年年底京东曾说过,2018年要给每一位员工的年终奖翻倍。然而最近几天,有京东的员工匿名在网上发布消息,说是公司取消了2个月的年终奖。
有人在网上发帖表示,美团年终考核,绩效最差的比例最少为10%,高的能到20%,这些人的年终奖都将大打折扣。还有美团员工称,已有同事听到年终奖取消的消息。
不过,究竟这几家公司的年终奖发放情况如何还有待查证。
年终奖,体现一个公司的格局
马云曾说,员工离职主要原因只有两个:钱给的不够、心受委屈了。
从人力资源的专业角度看,企业发放年终奖的考虑有两点:表彰头部员工、激励腰部员工,以及控制离职率。办年会,一是传承企业文化,二是丰富员工福利。但同时,年终奖模式存在的几个主要缺陷:
1、基本达不到员工对年度收入的期望。
2、激励性非常差。
3、属于鸡肋型的福利性成本。
4、由于经常性的分配不公平带来诸多的内耗。
5、员工春节后流失的主因之一。
年终奖或许存在一定弊端,但它对员工也有很大的激励作用。同时,年终奖也反应了公司的福利水平、经营状况和管理理念。每当各大公司给出优厚年终奖时,总有网友评论想去这些公司上班,这也发挥了招聘广告的作用。

《2018白领年终奖调查报告》显示,2017年有近六成白领明确表示年终奖会影响自己的跳槽决定,2018年只有不足四成选择“会”,选择“可能吧”的白领明显增多。

网传:微信员工年终奖人均280万元?关于年终奖,看看法律怎么说!

前阵子,“微信员工年终奖为280万元”的传言在社交媒体广泛传播。

1月25日晚,微博认证用户腾讯公司公关总监@腾讯张军 发布微博回应称:
那么,一般公司的员工,年终奖能有多少呢?这里有一组数据。
智联招聘发布“2018太原白领年终奖调查”,数据显示,超四成的太原白领能拿到年终奖,平均值为4330元。
总体来看,2018年太原白领的年终奖平均值低于7100元的全国平均水平,但年终奖满意度为3.19,全国排名第13,高于全国平均值(3.13)。
有钱当然开心,没钱肯定很伤心,同时一定还会有很多员工有埋怨和疑问,今天小编为大家整理了《劳动法》对年终奖的规定:

年终奖应该怎么发?
很遗憾,在目前的《劳动法》中是没有关于年终奖的规定的。但年终奖应根据劳动合同的约定或者用人单位的规章制度来发。
年终奖是用人单位根据企业当年的效益为嘉奖有突出贡献和业绩的员工而发放的特殊薪资,奖金发放属于用人单位的自主权,单位可以自行决定发不发奖金、发奖金的条件和标准。
企业一贯的做法是,不在劳动合同中约定奖金的相关事项,或者是单独将年终奖规定在绩效考核制度中,也有些还单独制定有关年终奖的制度,甚至有部分用人单位没有任何规定。
这些方法确实可以加大用人单位支付年终奖的随意性,但要是有员工因年终奖的发放与公司产生纠纷后,用人单位要承担举证责任,那时候会比较麻烦。
所以一定要在劳动合同中约定奖金的相关事项。

公司有权随意扣发年终奖吗?
第一种情况是,劳动合同中(或者规章制度里)明确约定年终奖金属于劳动报酬的一部分,那么用人单位不能无故扣发员工的年终奖金。
第二种情况是,劳动合同和规章制度都没有提到年终奖金的话,就还是那句话:扣不扣、扣多少要看老板心情......

新进、离职员工当年可以拿到年终奖吗?
还是分两种情况:
第一种情况是,劳动合同或者规章制度中有规定:要拿到年终奖,员工当年度必须在公司工作期满三个月;员工在发年终奖日前提出辞职或者因过失、非过失解除劳动合同的,将不得享受年终奖……有诸如此类的规定,自然是拿不到的。
第二种情况是,劳动合同或者规章制度都未对年终奖有明确规定,就要按同工同酬原则,如果员工选择劳动仲裁,法院一般会支持离职职工/新进员工得到一定比例的年终奖。

当然不可以!!
年终奖属于劳动报酬的一部分,多数公司会采用货币形式及股票期权激励方法发放,也有单位采用发放汽车、房屋等有较大价值的财产形式。
而有的单位竟将大米、酱油、大葱等生活用品作为年终奖,这些应当属于福利待遇,在未征得劳动者同意的情况下,擅自将发放形式变更为以物折抵,或者发放网络内使用的虚拟货币,这种变更行为显然是无效的,不能随便糊弄员工哦~

八姐也随机问了几个大互联网公司的童鞋,问问他们的年底福利到底咋样,嘿嘿,贴上来给大家看看。嗯,其实,你要是偷偷地作为年后跳槽的参考,我也并不介意哈。

员工A:我们还没发年终奖呢,应该是明天发。差不多平均每个人3-5个月吧。
员工B: 我们BG不算太多,但最基本也得有个两三个月的,我的同事有发六七个月年终奖的。微信支付团队和游戏的《王者荣耀》才是大赢家啊,不是听说微信支付300个员工就拿到了1亿元,平均每个人33万,而且,这还不是年终奖。。
阿里巴巴
员工小C:阿里年底双薪,现在不发年终奖,得等到4月份才发呢,年会也是那时开,所以,俺们部门即使有想离职的,也都得等到明年4月拿到年终奖后再撤。哈哈。
员工小D:阿里的年终奖是根据公司KPI和个人KPI综合打分的,区间3—4分,4分最高,但很少有人能达到,3.75分就是升职加薪和拿高额年终奖的分数了,3.5分是一般员工拿到的分数,分数3分基本就要被开掉了。去年,我的盆友在菜鸟评了3.75,差不多拿了7个月年终奖。我还有盆友因为去年余额宝业务不错,年终奖拿了16个月的薪水。

员工小F:我在大搜(搜索),我们今年的年终奖平均是两个月吧。百度是1-5分的打分,1分最高,平均员工是打3分的话,能拿到2个月工资的年终奖。但大搜今年的奖金可能总体不高,即便打了1分(最高了),因为系数比较低,最终也只能拿不到4个月的年终奖。虽然很多童鞋很郁闷,不过我觉得嘛,公司今年可能正在转型比较困难,可以理解,再说了,糯米什么的可能年终奖更低。当然啦,金融和无人驾驶什么的可能年终奖会多一些。

年终奖人均280万是不可能的
不久后,腾讯公关总监张军辟谣:
“今天朋友圈里都在为#微信年终奖#操心。小伙伴立马去查银行卡了,哈哈。but,别激动,我要告诉大家的是,年终奖有增长是真,多少不知道,还没到发的时候呢。人均280万?那是不可能的,醒一醒!”
不过从张军的回应来看,微信年终奖确实是有增加的。
其实,一般情况下,为了激励员工,很多公司在年底都会以各种形式发放年终奖。
年终奖在不同的单位有不同的发放形式,除了一般意义上的“红包”外,有的是股票分红,有的是“双薪”,有的是提成,有的是奖金。
不过,今年许多人反映,本来就不透明的年终奖“跑得连影都没有了!”
智联招聘报告显示,参与调查的白领中有55.17%表示能拿到年终奖,比例较2017年的66.1%下降明显。2018年的全国白领年终奖总体均值为7100元。仅39.10%的白领的年终奖收入增加了,持平的为45.35%,减少的为15.55%。

1、滴滴:取消高管年终奖,员工年终奖折半
据了解,滴滴2017年年终奖分ABC三档,A级别是6个月工资,B级别是4个月工资,C级别是2个月工资。有员工2017年到手的年终奖有四五万元。
而2018年的滴滴,一直在水逆。
据滴滴出行的财务数据显示,2018年上半年亏损急速扩大至40.4亿元,比2017年全年亏损的25亿元还要多出61%。2018年上半年滴滴的毛利率为1.6%,较2017年全年的1.9%下跌了0.3%。
在如此残酷冰冷的数据面前,2018年12月,滴滴CEO程维在全员大会上宣布“奖励”力度减半,而且高管集体不拿年终奖。

有人在网上发帖表示,美团年终考核,绩效最差的比例最少为10%,高的能到20%,这些人的年终奖都将大打折扣。还有美团员工称,已有同事听到年终奖取消的消息。
不过,究竟这几家公司的年终奖发放情况如何还有待查证。
年终奖,体现一个公司的格局
马云曾说,员工离职主要原因只有两个:钱给的不够、心受委屈了。
从人力资源的专业角度看,企业发放年终奖的考虑有两点:表彰头部员工、激励腰部员工,以及控制离职率。办年会,一是传承企业文化,二是丰富员工福利。但同时,年终奖模式存在的几个主要缺陷:
1、基本达不到员工对年度收入的期望。
2、激励性非常差。
3、属于鸡肋型的福利性成本。
4、由于经常性的分配不公平带来诸多的内耗。
5、员工春节后流失的主因之一。
