Army officer charged with raping daughter

By FARIK ZOLKEPLI

JOHOR BARU: A 38-year-old army sergeant claimed trial at a Sessions Court here for committing incest with his daughter. The accused, who is attached with the Pulada Army Camp here, was charged with raping his 13-year-old daughter at their home in Ulu Tiram at about 2.15am on Sept 16. The facts of the case stated that the accused had gone to his daughter's room while she and her younger brother were asleep.

He clamped his hands over the victim's mouth before unzipping his pants and raping her. He then threatened to hurt her if she revealed the rape. However, the victim's mother discovered the truth when she read a text message in the victim's mobile phone, containing the father's threats. She lodged a police report. The offence was classified under Section 376 (3) of the Penal Code for incest, which carries the sentence of not less than eight-year and not more than 30-year in prison and liable for whipping upon conviction.

The accused pleaded not guilty. DPP Nor Iffa Zarilla Abd Rahman asked the court to deny bail as the accused would pose a danger to the victim as he was the victim's biological father and would return home if bail was granted. Judge Habibah Mohamed Yusof denied bail and fixed Dec 9 for mention and submission of the medical report.
