The 25-year-old man who says NYPD officers sodomized him with a police baton after he resisted arrest in a Brooklyn subway station in October 2008 testified today. Two officers are accused of helping to cover up the brutality of another officer, Richard Kern, who is charged with aggravated sexual abuse and assault. In court this morning, the alleged victim, Michael Mineo, acknowledged he was a former gang member and said he ran from police who caught him smoking pot after they told him he was going to be arrested. Mineo's account of what happened when they caught up to him in the Prospect Park subway station is harrowing:

I felt a hard object being forced into my crack. It was pain. I was disorientated. I saw white light....It was one, two, three, then it stopped for a second, then I felt it go in, penetrate...I was like, 'Help me! They stuck something in my ass!

Mineo testified that after the sodomy, one of the officers, Alex Cruz, said, "You liked it, you faggot." But when he reached into the back of his pants and showed the officers the blood on his hands, they decided to let him go with an improperly-filled out summons for disorderly conduct. "Look, you help me out, I help you out," Officer Kern allegedly said, according to Mineo's testimony. "If we let you go, you can't go to a precinct or a hospital. But if you do, we have your address. We'll put a felony on you."

Officer Testifies He Saw No Abuse of Mineo

A police officer who helped arrest Michael Mineo testified on Wednesday morning that he never saw any of his colleagues pull down Mr. Mineo’s pants or jab a baton into Mr. Mineo’s buttocks as they arrested him in a Brooklyn subway station in October 2008.
The officer, Noel Jugraj, also said he was angered after his colleagues decided to let Mr. Mineo go with a summons, saying he easily could have been charged with felony after leading police officers on a chase.
Officer Jugraj has not been charged in the case. His partner, Officer Alex Cruz, and another officer, Andrew Morales, face charges of covering up abuse that prosecutors said was committed by Officer Richard Kern.
The prosecution called Officer Jugraj, but it was not clear how helpful he was to their case. He said that Mr. Mineo said he was “violated,” but the meaning of the word was unclear after his testimony: When officers first encountered Mr. Mineo, he had pleaded with them not to “violate” him — presumably meaning issue him a violation — because he was on probation for a previous arrest, Officer Jugraj said.
A prosecutor, Jeffrey Ferguson, asked Officer Jugraj a number of questions about the frantic seconds after he confronted Mr. Mineo, threw him to the ground and helped other officers handcuff him. He testified that a short time later, Mr. Mineo was screaming, and said: “You all violated me. You all violated me. I don’t want to go to jail.”
According to Officer Jugraj, Officer Cruz told Mr. Mineo: “Yeah, you liked it. You liked it.”
Officer Jugraj also said that he saw either blood or feces on one of Mr. Mineo’s hands.
Prosecutors have said that the fact that Mr. Mineo was let go with a summons proves the officers tried to cover up the abuse.
Officer Jugraj testified that he was angry when Officer Kern told him that they were going to let Mr. Mineo leave with a summons. He said he believed that Mr. Mineo could have been charged with felonies, including criminal tampering, for eating a marijuana cigarette when he was confronted by police officers, and for reckless endangerment.

“That guy made us chase him,” Officer Jugraj said, noting that one of the officers could have been hit by a car. “He ran on us.”

It's getting ugly.
The Brooklyn man who claims he was sodomized by a cop lashed out at the defendants, asked for a recess, and was ordered by the judge to calm down.
"One of you did something to me and it's going to come out - it's going to come out," an agitated Michael Mineo shouted at Officer Richard Kern and two other cops, angrily pointing.
"I'm a victim and I'm the one getting treated like I did this to myself."
Mineo has accused Kern of shoving a baton in him after he was arrested on Prospect Park subway platform Oct. 15, 2008. Officers Andrew Morales and Alex Cruz are charged with a cover-up.
The defense claims Mineo caused the injuries himself, and under cross-examination, he lost his temper.
Within 40 minutes of taking the stand, he asked the judge for a break, and the judge told him to have patience.
The courtroom was packed for the fireworks, and the mother of slain cop Russel Timoshenko, who attended Police Academy with Kern, was watching.
Mineo was questioned about surveillance video that showed him walking down the street alone soon after the confrontation, apparently uninjured.
He also was asked to inspect the boxer shorts he was wearing at the time. There were two holes - one allegedly from the attack, and another where material was removed for forensic testing.
"Uh-oh, who made that second hole there?" Mineo said quizzically. Then, in a bit of odd phrasing that the defense might seize on, he added: "I didn't do that. I didn't make two holes."
Kern's lawyer, John Patten, also asked Mineo to replicate the blood-curdling scream says he let out when the attack occurred.
"Come on, this is ridiculous," Mineo yelled through the courtroom. "Is this your defense, is this your best defense?"
"Have you ever been to acting school?" Patten asked coolly.
"Have you?" Mineo shot back.
The former tattoo parlor worker denied defense assertions he's a publicity hound seeking a huge payout in a civil suit.
"I just wanted my voice to be heard," he said.

Lawyers for three cops on trial for a sodomy attack on a suspect branded the alleged victim a lying scammer who caused his own injuries - while his hands were cuffed behind him.
"He was digging and digging at his backside," John Patten, lawyer for Officer Richard Kern, said in opening arguments Thursday.
The accuser, Michael Mineo, was not in the Brooklyn courtroom as the defense team attacked his criminal history and his $440 million civil suit.
Mineo claims Kern, 26, chased him into the Prospect Park subway station for smoking pot and rammed him with a baton.
Kern faces 25 years if convicted. Officers Alex Cruz, 28, and Andrew Morales, 27, could face four years on coverup charges.
Cruz's lawyer, Stuart London, told jurors there wasn't anything to cover up - that Mineo had a "preexisting medical condition." It was obvious to a fourth cop at the scene that Mineo, 25, was making it worse, London said.
"What are you doing back there?" Officer Noel Jugraj asked, according to London.
Prosecutors and their witnesses painted a different picture.
They said Jugraj heard Cruz tell Mineo, "You liked it," after the tattoo-parlor worker complained about the manhandling.
James Dallas, 13, who was visiting his subway-worker father at the station, said he saw cops cuff Mineo and ask about the drugs.
"One of the other officers said, 'He put it in his butt,'" the teen said. "The guy said, 'I didn't put it in my butt, I swallowed it.'"
James' mother, Andrew, said she saw Mineo led to a police car with his pants falling down.
"He was screaming, 'I can't believe you shoved a walkie-talkie up my ass like I'm some kind of faggot,'" said Dallas, who misidentified Kern as Mineo twice in the courtroom. "And one of them said, 'You are a faggot.'"
Mineo is expected to be on the stand Monday, and he'll face a tough grilling from defense lawyers - who claim a conviction against the cops will bolster his lawsuit.
"He's trying to scam the people of New York City," Patten said.
"You should send Mr. Mineo packing back to the state of Pennsylvania where he has many [outstanding] warrants."
Prosecutors say medical evidence and police witnesses will prove Mineo is a victim.
"There's no explanation, there's no excuse for what happened to him," prosecutor Charles Guria said.
