TWO men who raped and molested a 19-year-old girl while she was in a drunken stupor at a friend's birthday party were sentenced to jail and caning on Wednesday.
The man who was found guilty of rape was given 5 1/2 years jail term and six strokes of the cane, while the other who was convicted of molest, got 10 months jail and three strokes of the cane. Both are 22.
They cannot be named to protect the identity of the victim.
The teenage girl was so drunk, she could not do anything to fend off the two men who abused her.
When she awoke later, she burst into tears and told her boyfriend, who was in the next room, what had happened.
She was then taken to Changi General Hospital for a check-up and a police report was lodged.
On Wednesday, the two men, now both 22, were brought to task in a district court.
The man who raped the girl could have been jailed up to 10 years and caned. His friend could have been jailed up to two years and caned.
Tears streamed down both men's faces when the sentences were passed.
Pleading for leniency for the accused convicted of the rape charge, his lawyer S.S. Dhillon told the court that his client, who is married with two children, stopped what he was doing 'on his own accord' after he had been told to do so.
However, District Judge Jill Tan told the court that he had initiated the lewd acts against the victim.
She said: 'What began as inappropriate physical contact with her progressed to rape, an undeniably abhorrent offence. It was purely fortuitous for him that the other man stopped him from going further.'
As for the second accused, Deputy Public Prosecutor Tan Kiat Pheng said he should not get a lesser punishment because he stopped the other man.
He said: 'The hurt had already been done to the victim.'
The man's lawyer had earlier urged the court to consider giving his client 'brownie points' for his actions.
According to court documents, the girl had gone to a party at a friend's flat on Sept 21, where she planned to meet her boyfriend, who was also invited.
The couple kept to themselves as they did not know the host's friends.
It was only later that they joined the host and two of his friends for a card game, in which the loser of each round had to drink from a glass of whisky.
The girl, who was not much of a drinker, soon became drunk and, at her boyfriend's suggestion, went to the bedroom and fell asleep.
In the wee hours of the following morning, two men whom they had played cards with, entered the bedroom to look for a mobile phone earpiece.
They carried out their acts after they closed the door behind them. The girl was shocked and woke up but was too drunk to resist their advances.
