A PUB manager did not join in the assault on five men on July 1 last year but James Lewis De Souza, 34, was still jailed for eight months. A district court decided that he was nevertheless part of an unlawful assembly out to seriously injure the victims. De Souza, 34, received a call from his boss Ong Tian Yew, 39, then the owner of the New After Six Pub at Duxton Hill, at 10.40pm on June 30, to go to BJ Karaoke in Upper Bukit Timah Road, where Ong's friend had been hit on the head by a patron. Shortly after he arrived there, an attack broke out. Three of victims suffered cuts and fractures. One had his liver pierced and was hospitalised for seven days. Ong has earlier been jailed 1 1/2 years in jail and given six strokes of the cane while another attacker was jailed for five years and ordered to be caned 12 times. De Souza, who also pleaded guilty, appealed. In his grounds of judgement released on Oct 8, District Judge Ch'ng Lye Beng said that the punishment was appropriate as De Souza did not disassociate himself from Ong's group and had remained with Ong.
