<!-- Begin .post --> Singaporeans urged to Observe and Monitor Malaysian Court Decisions on Perak

I am urging fellow Singaporeans to fulfill our roles as international observers to monitor and react if necessary for our friends and relatives in Malaysia, for the on going developments in Perak. This role is important as our country Singapore being a closely connected and historically related neighbor of Malaysia. If we showed negligence and apathy toward Malaysian matters, then we can not expect our Malaysian friends and neighbors to show any concern over any injustice or crisis that we could be suffering as Singaporeans.

The Chinese idiom of 家家自扫门前雪,described the selfish apathetic attitude of disregarding any matter beyond the tight boundary of your very own front yard. That idiom actually educates people to exercise some selflessness by e.g. helping to sweep snow off neighbor's front yard, instead of just your very own. This community spirit is very simple to understand that being selfish apathetic and mindless of your neighbors' well being, one can not expect to receive any help from neighbors in return.

I am not urging Singaporeans to overstep into any area that is beyond our role as a neighbor. To observe and monitor and lend a voice of justice and share our views, express our concern, and exercise our influence positively as friend and neighbor and family relatives should be the limit.

Singapore and Malaysia shares the same history as British Colonies and had been together as a federation, our peoples had nearly been through the same route of development. It will be healthy meaningful and momentous to cross share our experiences as peoples of Singapore and Malaysia. Therefore I suggest that we should also learn the Malaysian experience for our own reference and learning, this would be helpful on our own route of reform.

As I had expected, it was still to early for Pakatan to celebrate yesterday. Fight will still proceed on and there would be more exchanges and outcomes in due time before the matters of Perak to be settled. Many Singaporean had been sharing the happiness yesterday, but I said, must still closely monitor and it was too early to celebrate still.

赞比里上诉成功获暂缓执行令

峰回路转的霹雳州大臣双包案打回原形!上诉庭在今午批准国阵大臣赞比里律师团的申请,暂缓执行吉隆坡高庭昨日宣布尼查是合法大臣的裁决。

赞比里也已经针对高庭的裁决,在今早第一时间正式提出上诉,而上诉庭将尽快择定日期聆听。

上诉庭的这项裁决也意味着,自昨日高庭作出裁决后,尼查仅“复工”当了约19个小时的合法霹州大臣。

在上诉庭做出宣布后,尼查及民联行政议员也在下午2点40分撤出仅重返逾7小时的办公室,离开霹州政府大厦,以示尊敬法庭裁决。

赞比里恢复视事,反促尼查搬空

在成功申请暂缓缓执行高庭裁决后,赞比里的律师也以“其人之道还治彼身”,要求尼查尽快搬空他刚在今早“复工”重返的办公室,以便让赞比里重新迁入。

在获得上诉庭批准暂缓执行裁决后,赞比里表示他将会马上恢复视事,履行其霹州大臣职务,并要求尼查遵重上诉庭的决定。

尼查代表律师将会尽快入禀撤销

尼查代表律师苏莱曼在上诉庭做出决定后表示,将寻求当事人的下一步指示,以便尽快入禀上诉庭,以撤销赞比里所获得的暂缓执行高庭裁决的申请。

较早前,尼查在霹州大臣办公室即时回应说,他将先徵求法律意见后,才决定如何应对赞比里的暂缓执行裁决申请。

“我们必须先了解这项裁决的影响,若获得暂缓执行裁决,究竟影响到什么层面?”

他认为,不管朝野双方采取任何的法律行动,都应该抱持诚恳的态度来迅速解决这场政治危机。

针对在上诉庭作出裁决后,霹州政府大厦外的镇暴队及警员人数突然激增一事,尼查表示他不会对此感到忧虑。

与过往一般上诉庭召开三司会审不同,上诉庭法官蓝里莫哈末阿里(Ramly Mohd Ali)今日单独决定批准赞比里暂缓执行裁决的申请,此举在过去曾经有过先例。

申请暂缓执行裁决免解散州议会

赞比里的代表律师西西尔阿布拉罕(Cecil Abraham)指出,答辩人之所以要申请暂缓执行裁决,是为了阻止尼查觐见苏丹要求解散州议会,与此同时国阵也要针对高庭的裁决进行上诉。

他指出,若霹州苏丹同意解散州议会,上诉就变得毫无意义了。

他声称,若州议会被解散,究竟谁是合法大臣的争议将会遭到改变。

西西尔阿布拉罕是援引今日的媒体报道,包括《当今大马》的报道,来证明尼查试图解散州议会。

总检长指召开州会最佳解决方案

而介入此案的总检察长阿都干尼也支持有关的上诉,并认为解决霹州政治僵局的最佳解决方案,就是透过召开州议会,决定谁是大臣。

终止州秘书及州法律顾问不合法

阿都干尼也声称,尼查在恢复合法大臣身份后当晚马上宣布停职州秘书及州法律顾问的决定不合法,因为这两个职位皆是由联邦政府所委任的。

民联律师明日入禀撤销暂缓令
尼查获得法庭背书合法性更高 5月12日 傍晚6点32分 民联律师表示,上诉庭只是暂缓执行吉隆坡高庭昨日宣布尼查是合法大臣的裁决,并非完全撤销有关判决,因此尼查的合法性仍然比国阵大臣赞比里来得高。

民联律师陈国强指出,两名闹双包的州务大臣对比之下,尼查比赞比里更合法,因为尼查至少拥有一个法庭的判决作为合法依归。

赞比里没法律依据任大臣

他说,赞比里不能够自圆其说的辩称本身依然是州务大臣,后者没有任何法律根据或权威继续执政。

“与赞比里相比,尼查与其政府拥有更高的道德与法律地位。虽然法庭指尼查是合法大臣的裁决暂缓执行,但是尼查至少拥有一个判决,而赞比里没有。”

“判决只是暂缓执行,并非撤销。道德胜利依然属于我们的,尽管法律上的胜利受到暂缓令‘瘫痪’了。”

高庭裁决比上诉庭有分量

他说,他们经过数周的准备及庭上的针锋相对,法官终于做出有利民联的判决;但是,这个裁决却在短短一个上午,就被区区一名法官谕令暂缓执行。

“我们相信,(高庭法官)阿都阿兹的裁决远比上诉庭今午的谕令,更有分量。”

赞比里勿重新占据办公室

另一方面,民主行动党国会领袖林吉祥指出,由于数名律师皆对上诉庭在区区一名法官的聆审下,即决定暂缓执行高庭的裁决,感到惊讶。

因此,他说,民联律师将在明日提呈紧急申请,要求撤销上诉庭批准的暂缓执行令。

“赞比里和行政议员们不应该重新占据州政府大厦,以免在数个小时之后又必须再次撤出。”

尼查:我还是合法的大臣

尼查在撤出州政府大厦后,在行动党总部召开新闻发布会,质疑上诉庭迅速批准暂缓执行令的做法,引起更多的问题。无论如何,他说,民联将会遵守这项决定。

他否认民联恋栈权位的说法,并强调昨日在获得高庭的判决后,民联第一件事就是要求解散州议会;相反地,他说,其实是国阵并未把人民放在第一位,才导致霹雳州如今的局面。

他表示,民联将会咨询法律意见,探讨下一步的行动;他也坚称,本身仍然是合法州务大臣,因此有权利要求觐见霹雳皇储。不过,至今仍未获得皇室的回应。

国阵霹雳州务大臣赞比里在今午成功向上诉庭申请暂缓执行高庭裁决后,立即向民联大臣尼查下逐客令,希望对方尊重法庭的判决,马上迁出州政府大厦。

“我希望尼查尊敬这项裁决......就像我昨日一样,当法庭作出裁决时,我没有去上班,也没有前往皇宫(出席册封仪式)。”

赞比里表示,随着上诉庭同意暂缓高庭裁决,他将继续执行州务大臣的职务,直到案件进入最后的联邦法院程序,获得最终的了结为止。

赞比里是在上诉庭今午宣布裁决后,于怡保的霹雳巫统大厦,匆忙地召开一场记者会。陪同赞比里召开记者会包括一众巫统州议员与州领袖。

尼查是在昨日获得吉隆坡高庭宣判为合法的霹雳州务大臣,在今早率领全体民联行政议员进入州政府大厦复工。不料因为赞比里今早成功申请暂缓吉隆坡高庭的裁决,民联仅当了逾7小时的合法政府,就必须再次交出州政权。

不愿透露何时返回办公室

询及若尼查不愿搬出州政府大厦,赞比里回应说,“我们再看情况如何,这不是‘如果’的问题,这是‘必须’的问题,这是法庭的裁决”。

“一切照旧......我们将迁入办公室。”

但是赞比里却不愿透露他将会何时重返霹州政府大厦复工,以免进一步激化政治对立。

至于尼查再度失去大臣职,那么今早尼查呈交给霹雳苏丹要求觐见,以解散州议会的公函是否仍有效时,赞比里不置可否表示,“我无法评论,但你们清楚了解”。

“当法庭作出裁决时,之前所发生的一切都不再有效。”

将采取政治行动打破僵局

尽管记者不断追问国阵是否会借此机会召开紧急州议会,以向尼查发动不信任动议来推翻他,赞比里始终守口如瓶,“现在仍言之过早”。

在旁的前州务大臣达祖罗斯里也补充说,“船到桥头自然直”。

不过赞比里呼吁人民放心,国阵肯定会展开政治行动,“不会太久,相信我,我不会让这个情况持续下去”。

达祖罗斯里这时意有所指透露,“下周自有分晓”。

针对民联以赞比里并非合法大臣来否决上周四(5月7日)州议会的合法性,连带不承认国阵议长甘尼申的地位,赞比里提醒尼查,召开州议会是苏丹的权利,并非州务大臣。

“我想他清楚这点,只是不懂为什么他假装不懂。”

民联准备与纳吉会面化僵局
安华:解散霹议会立场不变 李伟伦 | 5月14日 下午4点34分 民联今日正式表态接纳首相纳吉所伸出的橄榄枝,准备与国阵商谈如何解决霹雳州的政治僵局。

民联是今午在吉隆坡回教党总部大厦举行会议后,召开记者会做出这项议决。几乎所有民联巨头都出席了这项会议,其中包括国会反对党领袖安华、行动党国会领袖林吉祥、回教党主席哈迪阿旺、民联霹州大臣尼查等。

安华表示,民联愿意以开放的态度会晤纳吉,不会预设任何的条件,以解决霹州的政治僵局。

虽然如此也是公正党实权领袖的安华重申,民联要求解散霹州议会的立场不变,坚持重新交由人民来选择州政府,也不会与国阵合组霹州联合政府。

这也是民联首次表明立场愿意与纳吉当面洽谈霹州的宪政危机。

民间支持重选纳吉应从善如流

他继说,既然许多非政府组织如人权委员会、律师公会、学者包括国阵领袖们,都纷纷要求解散州议会,因此纳吉应该从善如流。

民政党全国总秘书邓章耀、该党的槟州主席丁福南及马华公会署理主席蔡细历等皆不约而同,支持解散州议会。不过丁福南的立场却已经受到巫统霹雳古布牙也区州议员拉惹阿末的强烈炮轰。

行动党国会领袖林吉祥在5月7日的霹雳州议会爆发原任议长西华古玛被抬走,议会上演武斗,议会外出现大逮捕的混乱现象后,率先倡议纳吉应与民联会面,以化解霹州政治僵局。纳吉随后表态表态愿意与民联会面,但他今日重申,有关的会面,不得附带任何预设条件。

解散立场分歧见面基础何在?

不过受询及,既然民联及纳吉针对解散州议会解决霹州僵局的立场有明显的分歧,那么朝野会面的意义究竟何在?安华却拒绝做出正面回应。

他仅笑称,若会面成事,他们将再告知媒体。

“民联将会给予民联的意见,若国阵也要给意见,民联将会听取,到时再看怎么样。”

纳吉会看报纸,民联再观察

当被进一步追问,由于纳吉早前声明把解散州议会的决定交由苏丹决定,民联会否在解散州议会一事上妥协时,安华表示民联的立场非常清楚,即必须解散州议会重选,但是民联也准备聆听国阵的意见。

至于民联会否正式提出与纳吉会面,安华轻描淡写地说,民联已经表明自己的立场,需要再观察进一步的演变,并声称“纳吉是会看报纸的”。

在会谈解决霹州僵局的议题上,民联此举显然是摆出愿意会谈的政治姿态,但却把球抛回给纳吉,施压国阵主动采取进一步具体行动。

安华也强调,尽管民联愿与纳吉会谈,但却肯定不会与国阵共组霹州联合政府。

“我们是要强化民主真谛,并要霹州政府机关依法工作,其他问题完全不存在。”

吉祥率先提出没提联合政府

最早建议民联与纳吉会谈的林吉祥在旁澄清,他从未提过要与国阵合组联合政府。

这名怡保东区国会议员也说,纳吉是主导整起霹州夺权戏码的人物,也是我国首相,因此最应该为霹州当前的危机负上责任。

The bigger question for Singaporeans to answer and be mindful is:

Will future Singapore be another Perak?

If the power change is only based on none other than electoral out-come, that means there is no additional strength and factors other than poll result to back up. A thin marginal poll victory can alway result in astable (Engineering term) oscillation scenario alike Perak.
