NEW YORK: Apple Inc must pay VirnetX Holding Corp more than US$625 million for using the patent licensing company's Internet security technology without permission in its FaceTime and iMessage features, a federal jury in Texas said on Wednesday.

The award was more than the US$532 million VirnetX had sought before the trial began on Jan. 25 in Tyler, Texas. The jury said Apple's infringement was wilful.

VirnetX stock was trading at US$9.30 after hours, up 94 percent from its Wednesday close. Apple was down 45 cents to US$95.90 in after-hours trading.

The verdict, though a blow for Apple, does not pose a threat to the company, which reported in January that its cash pile had reached US$216 billion. Still, the amount is high for a patent case.

Apple issued a statement vowing to appeal. "We are surprised and disappointed by the verdict," the company said. "Cases like this simply reinforce the desperate need for patent reform."

Also on Wednesday, Apple filed court papers asking U.S. District Judge Robert Schroeder to declare a mistrial, saying VirnetX's attorneys had misled the jury during closing arguments. It is not known when Schroeder will rule on that request.

"The jury saw what we have been saying all along: Apple has been infringing VirnetX’s patented technology for years,” VirnetX lawyer Jason Cassady said in a statement.

VirnetX, a Nevada-based company that derives most of its revenue from licensing patents, first sued Apple in 2010 over the iPhone maker's use of secure networks, known as virtual private networks, and secure communications links in Apple's FaceTime video conferencing application.

It was the second time VirnetX and Apple battled in court. In November 2012, a jury found Apple infringed four VirnetX patents with its iPhone, iPod Touch and iPad products, as well as with its Mac computers, awarding US$368.2 million in damages.

The U.S. Court of Appeals for the Federal Circuit, the nation's top patent court in Washington, D.C., partly overturned that verdict, saying there were problems with how the trial judge instructed jurors on calculating damages.

The retrial also incorporated claims from a second lawsuit VirnetX filed against Cupertino, California-based Apple in 2012 over newer versions of the Apple security features as well as its iMessage application.

VirnetX was assigned the four patents by Science Applications International Corp in 2006, court papers show.

In May 2010, VirnetX won a US$200 million settlement from Microsoft Corp over the VPN technology.

The case is VirnetX Inc v. Apple Inc in the U.S. District Court for the Eastern District of Texas, No. 12-cv-855.

The US is known as a litigious society where people can sue each other because it is easy to do so. Seems that some people make a living by suing. They don't actually make anything but claim to own a bunch of patents which they use to sue other companies. :smile:

Apple ordered to pay $625M in revived VirnetX patent trial

A federal jury on Wednesday found Apple guilty of willfully infringing on four VirnetX patents, awarding the non-practicing entity $625.6 million in damages and ongoing royalties from a previous court finding.

After a week of testimony and deliberation, a jury in the patent owner-friendly East Texas Federal District Court handed down a unanimous decision against Apple's FaceTime, iMessage and VPN services, as well as the devices running them, finding each in infringement of VirnetX intellectual property covering secure communications protocols.

VirnetX initially won $368.2 million in damages from Apple in a 2012 lawsuit involving the same IP, but that verdict was ultimately vacated on appeal last September. As part of its appellate ruling, the U.S. Court of Appeals for the Federal Circuit called for a damages retrial, which resulted in today's decision.

In its retrial, VirnetX sought $532 million, though the sum was inflated to $625.6 million due to continued willful infringement on the patents-in-suit. The second court action also appended FaceTime infringement allegations on a new claim construction.

The first trial found Apple's VPN on Demand feature, used in iOS 3 through iOS 6, in infringement of VirnetX patent Nos. 6,502,135 and 7,490,151, leading to today's decision to dole out a $334.9 million damages award. The FaceTime version used in iOS 4 to iOS 6 and OS X 10.7 to OS X 10.8 infringed on patent Nos. 7,418,504 and 7,921,211. In addition, Apple willfully infringed on VirnetX IP with subsequent and current VPN on Demand, FaceTime and iMessage iterations, resulting in a $290.7 million hit.

"We are thankful for the jurors' hard work and attention in this case, and for reaching a just verdict," said VirnetX attorney Jason Cassady of Dallas law firm Caldwell Cassady & Curry. "The jury saw what we have been saying all along: Apple has been infringing VirnetX's patented technology for years."

Today's outcome is the latest in a string of wins for VirnetX, which has leveraged its patent portfolio against big-name tech companies to great success. Among the firm's targets was Microsoft, which settled out of court in 2010 for $200 million and again in 2014 for $23 million in a case involving Skype.
