SINGAPORE - Former China tour guide Yang Yin has filed an application to the High Court requesting that his assets no longer be frozen under a Mareva injunction.

The 40-year-old is currently embroiled in an ongoing civil suit over the $40 million assets of wealthy widow Chung Khin Chun.

The move comes after Yang was denied his weekly allowance of $3,000 which the court had previously granted under the Mareva order, said his lawyer, Mr Joseph Liow, on Tuesday.

The application was filed on Monday for the Mareva injunction to be "discharged" unless Madam Hedy Mok, niece of the Madam Chung, 87, agrees to pay the sum for his client's legal and personal expenses, he added.

When asked, Madam Mok's lawyer Andrew Lee told reporters that he is still taking his client's position on this matter.

The next hearing for the application will take place on Feb 24.

This is the latest development to take place in the legal dispute over Yang and Madam Mok over the assets of her aunt - estimated to be worth $40 million.

Yang, who also faces criminal charges, has been accused by the 61-year-old travel agency owner of manipulating her dementia-stricken aunt Madam Chung into handing over her assets.

In August last year, the court granted an order to freeze the assets of the former tour guide under the Mareva injunction. The order also stated that a weekly allowance of $3,000 be released for Yang's personal expenses and legal fees.

His wife Madam Weng Yandan, parents and former bailor have also been added as defendants to the ongoing civil suit.

Yang has been in remand since Oct 31 last year. He faces more than 300 charges in total, including two criminal breach of trust charges for allegedly misappropriating $1.1 million from Madam Chung.

In a fresh twist to the fight for control of a widow's wealth, former China tour guide Yang Yin insists that the $1.13 million sitting in four of his OCBC bank accounts was a gift from Chung Khin Chun.

Previously, he had said that he had been holding on to the money on the 87-year-old's behalf.

The 40-year-old Yang is also arguing that dementia-stricken Madam Chung does not have the mental capacity to change a will, in which she had left everything to him, to one in which most of her wealth will go to charity.

Her assets, including a $30-million bungalow in Gerald Crescent, are believed to be worth $40 million.

In another development, he is urging the courts to lift a freeze on his assets after accusing Madam Chung's niece, Hedy Mok, of not sticking to a deal in which he will be allowed to withdraw a monthly sum of $12,000.

Madam Mok, a 61-year-old owner of a tour agency, last August accused the former tour guide of manipulating her aunt into handing over control of her assets.

Madam Chung met Yang in 2008 when he was her tour guide during a trip to China. The next year, he moved into her bungalow. In 2010, the widow made a will leaving Yang all her assets, including her bungalow. Two years later, she granted him Lasting Power of Attorney (LPA). Yang says that the childless widow treated him like a grandson.

Madam Mok has since sued the former tour guide for damages and for allegedly breaching his duties under the LPA, which was revoked in November.

In August, the High Court ordered a freeze on Yang's assets, except for a monthly allowance of $12,000 to be released for his personal and legal expenses.

However, the former tour guide's lawyer, Joseph Liow, told reporters before a pre-trial conference yesterday that his client has not been able to withdraw money from his bank accounts.

"They have not honoured it," he said, adding that a court application was filed on Monday asking for the freeze to be lifted or Yang to be allowed to withdraw the money.

In court documents, the former tour guide - who also faced more than 300 criminal charges, including two for allegedly misappropriating $1.1 million from Madam Chung - said he had sent letters to Madam Mok's lawyers in September and October asking to withdraw funds. But he was told that he was not allowed to do so.

"During this time, all my ordinary living expenses and expenses for legal advice and representation have been financed by personal loans that I managed to obtain from my family and friends in China," he said, adding that such avenues have now been "exhausted".

In separate court papers, Yang, who has been in remand since Oct 31, also said that the $1.13 million in cash that he has in the OCBC bank accounts belonged to him, as it was a gift from Madam Chung in December 2010.

As to why he previously said in court papers that he was merely holding on to the money, he said: "I am not proficient in English."

SINGAPORE - Blogger Roy Ngerng, who was found to have defamed Prime Minister Lee Hsien Loong, will testify at a hearing to assess the amount of damages payable, said his lawyer M. Ravi today.

Mr Ravi also vehemently denied saying at a closed-door hearing on Monday that his client "did not want to be cross-examined" - as PM Lee's press secretary Chang Li Lin previously said in a statement.

Ms Chang, in the latest round of exchanges between the two on Wednesday, said: "Despite what Mr Ravi said in court, he has now publicly confirmed that Mr Ngerng is prepared to give evidence and to be cross-examined at the hearing to assess damages.

"The Prime Minister looks forward to that," she added.

In her statement on Tuesday, Ms Chang cited notes taken by law firm Drew & Napier, whose Senior Counsel Davinder Singh is representing PM Lee.

Mr Ravi today used the same notes to back up his own version of events, saying that the notes are "accurate, precise and complete as far as they go".

But Ms Chang said that Mr Ravi had, in using the notes, "carefully and selectively omitted his own words to the Court".

She pointed out that he did not cite the fact that he had told Justice Lee Seiu Kin on Monday: "Therefore, I won't be filing (an affidavit). Enough Your Honour, I won't be filing."

That, she said, was the "clearest admission of his indication to the Court that Mr Ngerng did not want to be cross-examined".

She had used this remark in an earlier statement on Tuesday to show that Mr Ravi made a "hasty U-turn", after Mr Singh said he would cross-examine Mr Ngerng if he gives evidence.

Mr Ravi said today that he had "moved swiftly to protect my client's right to have the final say (over whether to testify)... given the sudden display of fervour of my learned opponent to engage in cross-examination of my client".

He also said that the notes showed his indication that he would be taking instructions on whether Mr Ngerng would be giving evidence.

Justice Lee ruled in a summary judgment in November that Mr Ngerng had defamed PM Lee by suggesting that the Prime Minister had misappropriated Central Provident Fund savings.

At Monday's hearing, Mr Ngerng was ordered to pay PM Lee $29,000 in costs for legal fees and related expenses, with damages to be assessed later.

He also directed Mr Ravi to confirm by Jan 30 if Mr Ngerng would be giving evidence.

The comment is in response to former China tour guide Yang Yin's claim that the $1.13 million in his bank accounts was a gift from the widow.
Madam Chung Khin Chun, 87, is prepared to attend court personally to testify that she did not gift the money to Yang, according to her niece, 61-year-old Hedy Mok.

Mdam Mok had said that Madam Chung will be able to testify in court if 40-year-old Yang is not in court at the same time. The Chinese paper did not explain why Yang had to be absent for Madam Chung to testify.

In the latest twist in the Yang Yin saga, Yang Yin has filed court papers saying that the $1.13 million cash in his 4 OCBC bank accounts belonged to him as it was a gift from Mdm Chung Khin Chun in December 2010.

He previously filed papers in court stating that he was merely holding on to the money for Mdm Chung.

As to why he is changing his position now, he explained, “I am not proficient in English.”

Yang may not be proficient in English but certainly, he knows enough English to liase with Dr Intan, his MP.

In fact, he used to be a grassroots member in the neighborhood committee of Jalan Kayu in Ang Mo Kio GRC, serving under Dr Intan. In his grassroots work, he was also an “Integration and Naturalization Champion”, helping foreigners and Singaporeans integrate with one another.

Despite Yang saying that he isn’t proficient in English, ICA went ahead and approved his PR application. He made his first PR application in 2010 but it was rejected. In 2011, he succeeded, thanks in part to an appeal letter written by Dr Intan.

Yang is also arguing that Mdm Chung does not have the mental capacity to change a will. Mdm Chung made a new will in December last year to leave almost all her estimated $40 million fortune to charity. She had removed Yang from the new will altogether.

The new will made on 13 Dec, came 3 weeks after the Family Court ruled that Mdm Chung is mentally capable of deciding who should take care of her finances and personal welfare. This also allowed her to terminate a Lasting Power of Attorney (LPA) she granted Yang in 2012 which gave him control over her assets.

Last August, the High Court ordered a freeze on Yang’s assets, except for a monthly allowance of $12,000 to be released for his personal and legal expenses. However, Yang’s lawyer told reporters before a pre-trial conference yesterday (13 Jan) that his client has not been able to withdraw money from his bank accounts. “They have not honoured it,” he said.

The lawyer has filed a court application on behalf of Yang asking for the freeze to be lifted or for Yang to be allowed to withdraw his $12,000 monthly allowance.
Separately, Yang is currently facing 349 charges for the various offences:


  • 331 charges related to the falsification of his company’s accounts
  • 3 charges for immigration offences
  • 5 charges for cheating (presenting fake receipts to his accountant)
  • 8 charges for offences under the Companies Act
  • 2 charges for criminal breach of trust (CBT).
The 2 CBT charges relate to Yang allegedly misappropriating $1.1 million of Mdm Chung’s money – $500,000 in 2010 and another $600,000 in 2012.

The 8 charges under the Companies Act relate to Yang’s failure to provide balance sheets and profit and loss accounts from 2009 to 2013 which give a “true and fair view” of his company.

The 3 immigration charges are related to false declarations to enable him to obtain permanent residence in Singapore and his wife a Long Term Visit Pass. He had declared that his company’s turnover in 2009 and 2010 was $75,080 and $135,952, respectively. Mr Yang allegedly made these false declarations to the Immigration and Checkpoints Authority (ICA).

Yang has been in remand since 31 October last year. The next court session will take place on Feb 24.

Madam Chung Khin Chun, the wealthy widow embroiled in the controversy over her $40 million assets which were allegedly taken advantage of by PRC Tour Guide Yang Yin, may have to sell her bungalow to fund her daily expenses.

The bungalow at Gerald Crescent has been Mdm Chung’s home for over 50 years after she and her late husband bought it together in 1961.

However, her home will have to be sold as Mdm Chung has only $8,500 left in her bank account and she no longer has money to pay for her daily expenses which includes the hiring of two maids and a driver. Back in January 2010, there was over $1 million in the account.

The bungalow is estimated to be worth about $30 million but it requires about half a million in repairs as it has not been well maintained over the last few years.

For the past 5 years or so, PRC tour guide Yang Yin, his wife and two young children have been living in the home with Mdm Chung and it has since become dirty, with broken furniture and doodles drawn on the walls with marker.

The roof tiles have also not been maintained resulting in water leaking in and causing damage to the ceiling and walls.







The current plan is for Mdm Chung to sell her bungalow, buy a smaller $5 million home so that she will have enough money for her daily expenses and will still have enough left over to give money to charity.

At the moment, Mdm Chung is living with her neice, Mdm Mok who has been appointed Mdm Chung’s guardian by the courts.

The bungalow is home to a maid and Mdm Chung’s dog now as Yang’s family went back to China and Yang is still being remanded.

Yang is accused of having manipulated Mdm Chung and taking control of her assets after she was diagnosed with dementia and selling her priceless artwork, jewellery and more online to fund his extravagant lifestyle.

Yang has been charged with misappropriating $1.1 million of Mdm Chung’s money as well as over 300 other charges related to falsification of accounts for his business.
Yang claimed that the $1 million in his bank account was a gift to him from Mdm Chung but the widow said that such a suggestion as ridiculous as she would never gift someone $1 million.
