SINGAPORE - Former China tour guide Yang Yin has applied to the court to maintain some control over a widow's estimated $40 million assets after his Lasting Power of Attorney (LPA) was revoked last month.

The 40-year-old, who is also a beneficiary in Madam Chung Khin Chun's will, on Wednesday applied to be a defendant in the case brought by Madam Chung's niece Madam Hedy Mok, who is applying for full deputy powers to manage her assets and daily matters.

Yang's lawyer Joseph Liow said that being a defendant in the case would mean that Yang could object to Madam Mok's application or ask the court to set limits on her powers.

Earlier, the court had granted Madam Mok only limited deputy powers to commence legal proceedings on behalf of her aunt to preserve or recover her assets.

Mr Liow added that Yang has "the right to object" to her application as he has an interest in Madam Chung's estate. In 2010, the wealthy widow changed her will to appoint Yang as sole executor and beneficiary of her estate.

The next court session will take place on Jan 15.

Yang, a Chinese national, also faces 334 charges for immigration offences and falsifying receipts made to his company Young Music and Dance Studio. He met the widow in 2008 while acting as her personal tour guide on a trip to Beijing.

A year later, he moved in with the widow, who has no children, at her Gerald Crescent bungalow - estimated to be worth $30 million.

He is also involved in a separate lawsuit brought by Madam Mok, who is trying to add his wife, parents and previous bailor as defendants. She has alleged that Yang manipulated her aunt into handing over her assets.

I read former Straits Times editor Bertha Henson blog "The widow and her millions". She is curious about the identity of the lawyer acting for Yang Yin and the doctor who assessed Madam Chung's mental capacity before PRC cheat Yang Yin was granted lasting power of attorney in 2012.

Actually the identities of those two were made known to the public through the chinese evening papers Shin Min Daily News.

The doctor who certified Madam Chung to be mentally fit is Dr Jonathan Pang Sze Kang. Dr Pang is a partner in Aesthetic Concepts Medical Center and he is the director to the group of clinics Everhealth Medical Group. He is accredited by the Office of Public Guardian to issue Lasting Power of Attorney Certificates.

The lawyer who is acting for PRC cheat Yang Yin is Daniel Zhu Zhihao, an associate with Straits Law Practice who was admitted to the bar in 2011 (Admission Number: 180/2011/K). Knowing the huge amount of monies involved in this case, Daniel Zhu is probably hoping this may be a case which could boost his career.

Friends and relatives of Madam Chung have reported that Madam Chung's bank accounts are empty after Yang was granted the the Lasting Power of Attorney. Ex-employees of Madam Chung have stepped out to refute the wild accusations that Yang have made in court affidavits; the media has reported that a loyal driver for Madam Chung for more than 30 years was sacked by Yang and a former maid noted that Yang has made Madam Chung eat leftovers.

It is just bizarre that it takes a Singaporean to prove Yang's innocence. We will see how lawyer Daniel Zhu goes against the wishes of Singaporeans who want to see PRC cheat Yang Yin get what he deserves.

PRC tour guide Yang Yin applied to court yesterday (11 Dec) to block Mdm Hedy Mok, niece of millionaire widow Chung Khin Chun, from obtaining full deputy powers to manage her aunt’s assets and daily matters.

Mdm Chung has been diagnosed to be suffering from dementia, earlier this year.

Yang has filed an application to become a defendant in the case brought by Mdm Mok, seeking to obtain full deputy powers to represent her aunt in official matters. This includes managing her aunt’s assets.

Yang filed the application despite having his Lasting Power of Attorney (LPA) revoked last month.

The main argument put forth by Yang through his lawyer is that he is still a beneficiary in Mdm Chung’s will.

Being a defendant in the case, Yang will be able to object to Mdm Mok’s application or ask the court to set limits on her powers.

He could also argue for a power sharing arrangement with Mdm Mok since he is still a beneficiary in Mdm Chung’s current will.

Yang’s lawyer said that his client has “the right to object” to her application as he has an interest in Mdm Chung’s estate.

In 2010, the millionaire widow changed her will to appoint Yang as the sole executor and beneficiary of her estate.

“All options are open at this time,” Yang’s lawyer said.

The next court session will take place on 15 Jan.

Yang is also facing a separate lawsuit brought by Mdm Mok, who is trying to add his wife, parents and previous bailor as defendants. She has alleged that Yang manipulated her aunt into handing over her assets.

Yang Yin currently facing 334 charges

At the moment, Yang is facing 331 charges related to the falsification of his company’s accounts, Young Music & Dance Studio Pte Ltd, and 3 charges for immigration offences.

The 3 immigration charges are related to false declarations of salary so as to enable Yang to obtain his PR and his wife a Long Term Visit Pass (LTVP). He had also declared that his company’s turnover in 2009 and 2010 was $75,080 and $135,952, respectively. Mr Yang allegedly made these false statements to ICA in his applications.

Yang actually made his first PR application in 2010 but was rejected by ICA. In 2001, he succeeded, thanks in part to an appeal letter written by Ang Mo Kio GRC MP Intan.

At the time, he became a grassroots member in the neighborhood committee of Jalan Kayu in Ang Mo Kio GRC. Dr Intan is the MP for the ward. He was also an “Integration and Naturalization Champion”, helping Singaporeans and foreigners integrate with one another (‘PRC Yang not just an ordinary grassroots volunteer‘).

The earlier 331 charges were for falsifying the receipts of his company of which he is a director. He allegedly created receipts reflecting payment for activities such as piano lessons and training when there were no such transactions.

Some of the receipts, for example, showed a payment of $3,500 from “Chua Tee Tee” for “piano tuition 30 times and sound tuition 10 times”. Another was a $3,000 payment from “Heng Sah Bah” for “piano tuition 30 times + free times”.

The names when spoken in Hokkien sound like “fetch younger brother” (Chua Tee Tee) and “pay $300″ (Heng Sah Bah). Assuming these names are fictitious and given that Mr Yang does not know Hokkien well if at all (he is from Hangzhou), how was he able to come up with such names in the first place?

In all, the falsified receipts amounted to some $450,000 which accounts for the revenue “received” by the company from 2009 to 2014. The company needed to “receive” revenue in order to pay his salary which in turn was needed to support his Employment Pass application when he first arrived in Singapore in 2009. His EP application was approved when the Manpower Ministry was under the purview of Gan Kim Yong.

外甥女莫翠玲(61岁,旅行社老板)透露,富婆于前天下午,在两名见证人见证下,立下了新遗嘱。她补充,新遗嘱的内容和2009年的相同,富婆同样打算将财产捐做慈善用途。

根据新遗嘱,富婆会将50万元留给认识半世纪的挚友张碧贞、另50万元则交给姐姐钟燕铃,剩余的款项则存入以亡夫为名的邹习经医生信托(Dr Chou Sip King Trust)。

SINGAPORE - The niece of a wealthy widow has been granted permission by the High Court to sue not just former China tour guide Yang Yin and his wife, but also his parents and previous bailor.

The court on Monday allowed Madam Hedy Mok - the niece of 87-year-old Madam Chung Khin Chun - to include Yang's wife Madam Weng Yandan and his parents Yang Sannan and He Xianglan, as parties to the suit. His previous bailor Ms Ong Gek Lie, who paid $15,000 to bail Yang out when he was arrested in September has also been included as a defendant.

The next closed-door hearing for the suit is set for Jan 13 next year.

This is the latest development to take place between Yang and Madam Mok, who are embroiled in a legal tussle over Madam Chung's estimated $40 million in assets.

Earlier, Madam Mok took legal action against Yang to recover damages for allegedly manipulating her aunt into handing over her assets and for breaching his duties as her guardian under the Lasting Power of Attorney (LPA).

The LPA granted to him in 2012 has since been revoked.

Apart from the civil suit, Yang faces 334 charges for immigration offences and faking receipts made to his company Young Music and Dance Studio.

The wealthy widow fighting to retake control of her estimated $40 million assets has cut former China tour guide Yang Yin out of her will.

Madam Chung Khin Chun, 87, has made a new will which leaves nearly all her fortune to charity.

She has cancelled one made in 2010 in which Yang was set to inherit all her assets, including a $30 million bungalow off Yio Chu Kang Road.

The new will, made last Saturday, came three weeks after the Family Court ruled that the widow was mentally capable of deciding who should take care of her finances and personal welfare.

The court had allowed her to cancel a Lasting Power of Attorney (LPA) she granted Yang in 2012 which gave the former tour guide control over her assets.

In the new will, seen by The Straits Times, Madam Chung stipulated that $500,000 be given to Madam Chang Phie Chin, whom she calls her "dear friend". The retired teacher, 84, has known Madam Chung for more than 50 years and lived with her in her bungalow from 2005 to 2011.

Madam Chung's only sister Doris will get $500,000.

The rest will go into setting up a charitable trust named the Dr Chou Sip King Trust, in honour of her late husband - a general practitioner who died in 2007.

The couple did not have any children.

In the will, the widow appointed her niece, Madam Hedy Mok, a tour agency owner, to run the trust for 30 years and make annual donations to beneficiaries in four fields: education, children's charity, animal welfare and medical research.

"He has no more interest in my aunt's assets," said Madam Mok of Yang, adding: "He gets nothing. If he wants to challenge the will, he has to go to court."

Madam Mok added that her aunt's lawyer will be filing the new will in court soon.

The Chinese national had met the widow in 2008 while acting as her private tour guide when she visited Beijing with Madam Chang.

A year later, he moved into the widow's bungalow, claiming that she had adopted him as a grandson and asked him to look after her.

He set up a music and dance school and obtained an Employment Pass in 2009. He obtained permanent residency in 2011 and brought his wife and two young children to Singapore last year as his dependants.

The 40-year-old has since been arrested by police and charged in court. He faces 334 charges for allegedly lying to the Immigration and Checkpoints Authority and falsifying receipts made to his company, Young Music and Dance Studio.

He has been denied bail and has remained behind bars since Oct 31. He is due back in court for a pre-trial conference on Thursday.

Separately, Yang is also being sued by Madam Mok in the High Court for allegedly manipulating her aunt into handing over her assets.

Madam Mok is seeking damages and trying to add his wife, parents and previous bailor as defendants in the suit. The suit will be heard today.
