Re: Malaysian believed to be part of cheating syndicate charged

I picked up a wallet with four of $1,000 with couple of $100 notes and three local credit cards. I called the credit card company and told them to inform the owner to contact me. After half an hour, he called and told me to wait for him for 15 minutes as he was nearby. A well dressed man came 2 hours later, checked his wallet, counted the cash and without saying a word, walk away. Sometimes, it would be better to just bring those lost & found items to the police station. Yes, he is a PR from India.

Norwegian who choked cabby given chance to defend himself in retrial

SINGAPORE - A Norwegian who has served more than half his 10-week jail term after admitting to choking a taxi driver, paid the victim $30,000 and lost his job, has been given a chance to defend himself in a retrial.

This comes after two Singaporean men came forward to say that the cabby was actually the aggressor.

The High Court heard on Friday how Mr Mohamed Ayub Shaik Dawood and his friend Roslan Zainal witnessed the altercation last September at Circular Road.

When Mr Ayub read a newspaper report on the case, he was surprised that 50-year-old Arne Corneliussen was jailed while 46-year-old cabby Chan Chuan Heng, whom he saw throwing a punch, escaped punishment.

He sought out Corneliussen's lawyer and he and his friend have since filed affidavits on their account of what happened.

Corneliussen's lawyer, Mr Terence Seah, said his client had pleaded guilty because he was too drunk to remember the details of the fight and the police had eyewitness accounts that he had attacked Mr Chan.

Given the "exceptional turn of events", the prosecution did not object to Corneliussen's conviction and sentence being quashed and the case sent back to the State Courts for a retrial.

Deputy Public Prosecutor Wong Kok Weng stressed that this did not mean that the earlier conviction was wrong. He pointed out that the two new witnesses were not at the scene when police arrived and did not come forward during investigations.

Two passersby who had pulled Corneliussen away from Mr Chan told police that they saw the Norwegian chasing the cabby and choking him, said the DPP.

But Mr Ayub said he saw Mr Chan punch Corneliussen on the left side of his head, causing the latter to squat down in a daze.

When Corneliussen asked the cabby why he had hit him, Mr Chan tried to run away. After a few short chases to and from the taxi, Corneliussen caught up with Mr Chan and pinned him down, before being pulled away.

Mr Roslan did not see the punch but heard a loud smacking sound, after which he saw the cabby, arms akimbo, standing over Corneliussen, who was squatting with his hands covering his face.

SINGAPORE - When a 47-year-old engineer was caught holding his iPhone with its camera lens facing upwards under a woman's dress in Suntec City in November 2013, he at first denied that he had taken any upskirt photographs.

But police found 283 such images taken starting September that year.

Yesterday, the man, Sim Tiak Choon, was sentenced to eight weeks in jail after he pleaded guilty to three charges of insulting the modesty of a woman. Another eight charges were taken into consideration. In all, the charges involved 45 upskirt photographs.

Sim, a Malaysian who is a Singapore permanent resident, would walk behind women at shopping centres and take random upskirt photographs.

SINGAPORE - A 35-year-old Finnish tourist, naked and looking drunk, was spotted in the lobby of Fragrance Hotel in Selegie Road in March this year.

When two police officers arrived, they found him lying in a back alley nearby in just his underwear.

They managed to get the man, Antti Tapio Peltomaki, to put on a raincoat, but he removed it after a while and became agitated when they asked him some questions.

As the two policemen were trying to calm him down, Peltomaki suddenly slapped one of them, a 21-year-old national serviceman.

The police officers could not calm him down, and had to arrest him.

On Thursday, the Finn, who works as a sales manager with a video game magazine publisher, was jailed for four weeks for voluntarily causing hurt to a public servant in the discharge of his duty.

Peltomaki pleaded guilty, and told the court he was ashamed of his actions.

In his mitigation, Peltomaki's lawyer, Mr Louis Joseph, asked for a one-day imprisonment term with a fine, or not more than a week in jail.

The lawyer said that as a result of the case, the Finn had to extend his stay in Singapore for two months, "at enormous financial cost".

The offence was committed on the spur of the moment and there was minor injury caused, Mr Joseph said.

Peltomaki, who has a seven-month-old daughter, also offered to pay compensation of $1,000 to the Police Compensation Fund.

This is his first brush with the law.

For the offence, Peltomaki could have been jailed for seven years, fined and caned.

Bangladeshi construction worker fined $40,000 for unlicensed employment activities

AsiaOne Friday, May 15, 2015

SINGAPORE - A 28-year-old construction worker from Bangladesh has been fined of $40,000 in default four months' imprisonment for conducting employment agency activities without a valid employment agency (EA) licence issued by the Ministry of Manpower (MOM).

Ahmead Rubel, 28, helped to facilitate the employment of a fellow Bangladeshi, Jabed, to work as a construction worker in Nanjing Minglu Construction Engineering Co. Ltd from Dec 26, 2013 to June 9, 2014.

In the process, Rubel pocketed $3,000 as agency fees, MOM said in a statement today.

During the two-day trial from April 29 to 30, 2014, Rubel denied knowing Jabed, or any of the arrangements that led to Jabed's employment.

The State Courts later found Rubel guilty of conducting employment agency activities without a valid EA licence, on April 30, 2015.

"Foreigners holding valid work passes should not try to earn quick money by performing unlicensed EA activities," Divisional Director of MOM's Foreign Manpower Management Division Mr Kevin Teoh said.

"Foreigners who want to seek employment in Singapore, and companies which seek workers should approach licensed employment agencies for their employment and recruitment needs.

"The Ministry will clamp down on unlicensed EAs as they undermine the credibility of the industry."

The company that hired Jabed, Nanjing Minglu Construction Engineering Co. Ltd, was fined $4,000 on July 10, 2014 for using the services of Rubel .

Under the Employment Agencies Act, any person who operates or abets an unlicensed employment agency is punishable with a fine of up to $80,000 or up to 24 months' jail, or both. For subsequent convictions, a fine of up to $160,000 or up to 48 months' jail, or both, will be imposed.

Members of the public are advised to use only MOM-licensed employment agents for their employment needs. More information can be found on www.mom.gov.sg/eadirectory.

Drug trafficker gets reprieve one day before execution

Ghanaian to apply for re-sentencing after more than 6 years on death row

Published on May 15, 2015 8:14 AM
By Selina Lum

JUST a day before he was set to be hanged for trafficking 2.6kg of cannabis, Ghanaian Chijioke Stephen Obioha agreed to a last-minute reprieve which may save his life.

The 38-year-old, who was set to be executed today after being on death row for more than six years, finally said yes to being considered for re-sentencing.

After legislative changes to the mandatory death penalty came into effect in 2013, judges can impose a life sentence for drug couriers who satisfy certain criteria.

The Court of Appeal yesterday gave him a month to file the application. "I changed my mind because I want to live," said the burly man, who was flanked by guards in bulletproof vests.

In the past, he had repeatedly rejected the re-sentencing option which was given to more than 30 prisoners on death row, claiming it amounted to accepting that his conviction was correct.

Obioha, who said he came here in 2005 to try out for a football club, was arrested in April 2007 by anti-narcotics officers who found 14 blocks of vegetable matter in the bag he had with him.

The officers escorted him to his rental flat and found another 14 blocks in various bags.

In December 2008, after a 21-day trial, he was convicted of trafficking in 2.6kg of cannabis and given the then-mandatory death penalty.

In August 2010, his appeal was dismissed. His petition for clemency was rejected last month.

On Monday, his lawyers, who were discharged in February, were notified that he was seeking a stay of execution to allow further evidence to be introduced.

On Tuesday, Mr Manoj Nandwani and Mr Peter Ong were re-appointed as his lawyers. The next day, they filed the motion.

Obioha contended that the cannabis blocks were not checked for DNA, which would establish whether he had handled them.

Deputy Public Prosecutor Ng Cheng Thiam argued that this was a red herring as Obioha was raising this for the first time and the trial judge had found sufficient evidence the drugs were in his possession. During yesterday's hearing, Obioha changed his mind about the re-sentencing option.

This earned him a reprieve, while his request to introduce new evidence was rejected.

SINGAPORE - A woman was charged in court on Friday with assaulting a condominium manager, spitting and splashing liquid from a drink can at him.

Tang Lei, 47, a Chinese national, also allegedly hit Mr Colvin Quek Choon Kiat, 67, on his face and arms, causing bruises and abrasions over his forehead, at the Simei Green condominium management office at about 11.40am on April 28.

She was then with her sister, who has not been charged.

The incidents were recorded on video, posted online and went viral.

The women apparently had an argument with the condo manager over access cards.

Tang's lawyer Christopher Ravijit Singh Gill said he had just been briefed.

She is out on $10,000 bail and her passport has been impounded.

A pre-trial conference is scheduled for June 10.

If convicted of causing hurt, she faces a jail term of up to two years and/or a fine of up to $5,000.

The penalty for using criminal force is three months' jail and/or a fine of up to $1,500 per charge.

Woman entered Singapore under false identities

She had fled over fake degree, but returned using various passports

Published on May 20, 2015 7:35 AM
By Selina Lum

She fled the country after being charged in 2002 with using a fake degree to apply for permanent residency.

But that did not stop Lin Lifen, 39, from repeatedly coming back to Singapore over the next 12 years using different identities. She is now appealing against a 16-week jail sentence for her offences.

The wealthy businesswoman, who married a permanent resident from Canada, first returned to Singapore as Shuting Lin Grayston using a Canadian passport. Later, she used a Central African Republic diplomatic passport issued under the name Charlize Lin.

Each time, the Chinese national lied in arrival forms that she had never used a passport under a different name to enter Singapore.

In March last year, she was detained at Changi Airport after immigration officers noticed irregularities in her Central African Republic diplomatic passport.

Earlier this year, she pleaded guilty to one count of using a forged degree and three counts of making a false declaration.

Four other false declaration charges were taken into consideration. Her jail term has been stayed pending the outcome of her appeal.

In a written judgment published yesterday, District Judge Shawn Ho said Lin was a "wily wheeler-dealer who deliberately deceived the Singapore authorities with her duplicitous conduct".

Lin, who has a string of business interests including diamond mining, oil exploration and spas, said her main reason for coming back to Singapore was to spend time with her son. But the district judge said the evidence showed that it was the "powerful pull of profit, rather than familial bonds" that drew her back.

He said that in letters to the authorities in 2013, her lawyers said she wanted to move all her business interests here, make Singapore the head office for her oil business and invest $2 million in an apartment.

The district judge also rejected the defence's argument that the different names on the passports were not fakes adopted by Lin to mislead the authorities.

"Why was there a need to be chameleonic about her identity on official travel documents?" he said.

By re-offending after absconding while on bail, Lin had showed "total disregard of authority and blatant disrespect for the law", he added.

Between 1996 and 2000, Lin came to Singapore many times on a tourist pass.

In 2000, she was issued a dependent's pass under the sponsorship of her husband.

Lin, who has a primary school education, later got a fake bachelor's degree in economics from the Foreign Economics and Trade University in Beijing, as she wanted to get PR status here. But the university said the certificate was forged, following checks by the Immigration and Checkpoints Authority.

Vietnamese student, 22, jailed for taking upskirt videos

Published on May 25, 2015 12:53 PM
By Olivia Ho

SINGAPORE - A 22-year-old Vietnamese student was jailed for three weeks on Monday for taking upskirt videos of women.

Last September, Nguyen Tri Dung had stuck his Samsung Galaxy mobile phone under the skirts of women in busy public areas such as post offices and MRT stations and filmed them.

He was charged with four counts of insulting the modesty of these women, with two charges proceeded on.

Nguyen, who has been studying at a local university for two years, was arrested on Sept 16 last year when he took two videos of a Peruvian woman at a Pasir Panjang post office.

He had been there to post a parcel to his friend in Germany. In the queue, he spotted the victim, 27, found her attractive, and decided to film her.

The victim had been writing the address on a parcel when she felt a piece of plastic brushing against her leg.

She turned and saw the accused holding a phone in his hand. On seizing the phone from him, she discovered two upskirt videos of her on it. She then took his student pass and called the police.

Nguyen's lawyer Amarjit Singh Sidhu said in mitigation that his client was a first-time offender, that he was remorseful, and that this would be his last brush with the law.

He added that Nguyen had an internship with a reputable company and would be starting an exchange programme on a Ministry of Education tuition grant soon, and that a custodial sentence would deprive him of these opportunities.

He called instead for a probation suitability report. But Deputy Public Prosecutor Shen Wanqin pointed out the difficulties of keeping track of foreigners on probation if they did not have some local roots.

For each count of insulting the modesty of a woman, Nguyen could have been jailed up to a year, fined, or both.

By Selina Lum

SINGAPORE - A domestic maid who strangled her employer's 16-year-old daughter with the girl's own school pinafore while the teenager was asleep, was on Monday jailed for 12 years.

Indonesian Tuti Aeliyah, 30, pleaded guilty in the High Court to one charge of culpable homicide for killing Shameera Basha Noor Basha, a Secondary 4 student at Tanjong Katong Girls' School, on Nov 14, 2013.

Tuti was originally charged with murder, but the charge was reduced after she was diagnosed to be suffering from severe depression with psychotic symptoms at the time. Her mental condition was found to have significantly impaired her judgment.

The High Court heard on Monday that Tuti, who started working for the teen's family of four in April 2012, was not abused or ill-treated by her employers.

But several months before the killing, she started behaving strangely. She lost weight, did not want to call home and cried frequently. Two weeks before the incident, she told a neighbour's maid that she wanted to commit suicide.

She told a psychiatrist that the night before the killing, she tried to kill herself but failed.

The next morning, Shameera was still asleep and alone at home with the maid after her parents and brother left their Tampines flat. The maid claimed that while she was in the toilet, she saw a ghost which told her to kill the teenager.

At 8am, armed with a kitchen knife, she went into the teen's room and tried to smother her with a pillow. After Shameera woke up and struggled, the maid stabbed her in the abdomen and chest. The maid then looped Shameera's dark green pinafore around her neck a few times and pulled both ends until the teen stopped moving.

Tuti then drank half a capful of fabric softener, made superficial cuts on her wrist with a knife and tried to hang herself from from a toilet pipe but failed to kill herself.

Half an hour past noon, when the teen's mother returned home, the maid told her employer that she had killed Shameera. Shocked, the 47-year-old woman sought help from a neighbour, who called the police.

Irfan Syanjaya, 26, was convicted on Tuesday of outraging a woman's modesty on an MRT train. -- PHOTO: SINGAPORE POLICE FORCE

By Olivia Ho

SINGAPORE - An Indonesian PhD student was convicted on Tuesday of outraging a woman's modesty on an MRT train.

Irfan Syanjaya, 26, had been taking the train from Buona Vista to Jurong East on Aug 12 last year, when he deliberately stood close behind the 20-year-old student to do so.

He was sentenced to six weeks' jail following a two-day trial.

The court heard that although the train was crowded at first as it was the evening peak period, it grew more empty after leaving Dover station. Nevertheless, Irfan continued to stand close to the victim even though there was space to move away.

She confronted Irfan, who apologised. Other commuters came forward to help and he was detained by security officers at Jurong East MRT.

During the trial, Irfan, who was unrepresented, maintained that he had touched the victim accidentally.

He had admitted during police investigations earlier to intentionally touching her, but denied this in court.

When asked why he kept standing so close to her, he said through a translator: "She seemed to have no negative thoughts about me so I did not move away.

"I assumed she had no problem about me standing where I was."

Three witnesses who had been in the same carriage testified that they had seen Irfan make deliberate contact with the victim, even after she tried to avoid him.

One, Ms Nur Sharida Md Farok, said Irfan was standing close enough to whisper into her ear.

Another, Mr Johan Tay, said it was obvious that he had been inching towards the victim. He said he had tried to stop it from happening by putting his bag in between Irfan and the victim, but that Irfan had persisted.

At the time, Irfan was doing a PhD in electrical and computer engineering at the National University of Singapore.

For using criminal force to outrage the victim's modesty, Irfan could have been jailed for up to two years, fined, caned, or any combination of the three.

Man gets jail and six strokes of the cane for molesting and sexually abusing girl

Published on May 26, 2015 2:23 PM
By Elena Chong

SINGAPORE - A man who molested and sexually abused his lover's young daughter 10 years ago was sentenced to a total of six-and-a-half years' jail and six strokes of the cane on Tuesday.

The 39-year-old Malaysian, who faced 12 charges, admitted to two counts of outraging the modesty of the girl, and one of unnatural sex at a flat in Tampines in 2005.

The victim, now 19, was about nine or 10 at the time.

A district court heard that he was living with the girl's mother, who is divorced.

While the mother was at work one Sunday in February 2005, the man, then a material and freight handling worker, played a pornographic DVD while he was alone with the victim in the master bedroom.

He took off his boxer shorts and undressed and molested her.

Deputy Public Prosecutor Ramesh Ethan Ananda said the victim did not even realise that the man should not be touching her.

On other occasions, he molested her and he made her perform oral sex on him.

She did not tell anyone what had happened.

But in 2013, she accidentally spoke about the sexual encounters with the man, while she was having dinner with him, together with her biological father and her boyfriend. Her father was enraged and told her to lodge a police report.

The man's lawyer, Mr Chung Ping Shen, said in mitigation his client had cooperated with the authorities and had been guilt-ridden.

He tendered various documents to show the support his client had from family members, employers and even the victim and her mother, who is still in a relationship with him.

The man could have been jailed for up to 10 years and fined for the unnatural sex offence. For molestation, he could have been jailed for up to two years, or fined, or caned or punished with any two such punishments on each charge.

Former kitchen help gets 17 years, 24 strokes for rape, robbery

Chang Kar Meng was sentenced to 17 years' jail and the maximum 24 strokes of the cane after he pleaded guilty to one count each of rape and robbery with hurt at about 1.30am on March 8, 2013. -- PHOTO: SINGAPORE POLICE FORCE

By Selina Lum

SINGAPORE - A 27-year-old kitchen worker crept up behind a 35-year-old woman while she was waiting for the lift in Paya Lebar, knocked her senseless, then robbed her before dragging her to a nearby grass patch where he raped her, the High Court heard on Thursday.

Chang Kar Meng was sentenced to 17 years' jail and the maximum 24 strokes of the cane after he pleaded guilty to one count each of rape and robbery with hurt at about 1.30am on March 8, 2013 .

The court heard that the woman, a foreigner married to a Singaporean, was on her way home after leaving work.

The woman, who worked as a waitress, was using her mobile phone at the lift lobby of her block of flats when Chang spotted her and decided to rob her as he was short of money.

He took off his slippers and placed them in the bushes and sneaked up on the woman as soundlessly as possible. He covered her mouth with his left hand and, using a move he learnt from the movies, hit the back of her neck. After a few blows, she passed out.

Just as he was about to drag her away, the lift doors opened. Chang lowered his head to avoid being captured by the surveillance camera inside. The footage was played in court on Thursday.

After the lift doors closed, he dragged her away and took her sling bag, jewellery and other valuables.

He then laid her down on a grass patch and took photos of her exposed breasts with his phone camera.

At this time, the woman came to but pretended to remain unconscious out of fear. Chang raped her, then used his T-shirt to clean himself as well as the woman. He took more photos of her bare breasts, dressed her and propped her up in a sitting position before making off with her bag.

The woman went home and told her husband that she had been robbed. He called the police. Chang was arrested 5-1/2 months later. The court heard that a large number of women's underwear was seized from him.

SINGAPORE - An assistant law professor from the National University of Singapore (NUS) was convicted on Friday for assaulting a cabby while drunk, leaving his victim bloodied and needing multiple stitches.

Sundram Peter Soosay, 43, had boarded Mr Sun Chun Hua's taxi in the wee hours on Christmas Day. Intoxicated with alcohol after a Christmas Eve gathering, he later vomited in the cab.

He then alighted near King Albert Park along Clementi Road and walked away without paying his taxi fare. He handed a $50 note over after the 70-year-old cabby chased him and threatened to call the police. Mr Sun returned to his cab to get change.

Soosay then allegedly struck Mr Sun from behind, straddled him and punched him on his face repeatedly.

An eye-witness saw a scuffle break out between the two. While uncertain of who started it, the witness saw Soosay kneeling down and striking Mr Sun on the head several times with his fist.

The court heard that he then ran towards them and shouted at them to stop the fight, as Mr Sun "did not look like he was capable of defending himself".

Soosay's lawyer said his client had walked away after the scuffle and did not attack the cabby.

District Judge Victor Yeo, in finding Soosay guilty, said that his testimony was "riddled with hindsight reasoning, convenient conjecture and hypothesis".

Tearing down his defence, District Judge Victor Yeo said Soosay's testimony was inconsistent with his first statement to the police.

"Despite the accused's intoxicated state, he seemed able to recall with great clarity how Mr Sun had behaved aggressively towards him," he said.

He added that Soosay had made no mention of these details in his first statement to the police, but had instead said he was so drunk that he could not remember what actually happened.

He also noted that Mr Sun was of a fairly advanced age, and it would have been foolish for him to start a fight with his passenger - who was larger in stature - after he had received money for the taxi fare.

Soosay will be sentenced on June 26. He faces up to two years in jail, a fine of up to $5000, or both.

In a statement on Friday, an NUS spokesman said Soosay has been suspended without pay, and the university "will now determine what further disciplinary action should be taken".

Bangladeshi cleaner jailed for attempting to rape maid in Woodlands carpark

SINGAPORE - A Bangladeshi cleaner lured an Indonesian maid to a Woodlands multi-storey carpark and attempted to rape her in broad daylight.

After a violent struggle, during which Mohd Nurul Islam Md Hatem Ali slapped and bit the victim and also violated her with his finger, he ran out of steam and told her to leave.

Nurul Islam, 33, was sentenced on Friday to six years in prison and eight strokes of the cane for the assault.

On the morning of Nov 2, 2013, the victim had gone to a nearby mall to buy breakfast for her employer's family.

While the 32-year-old was queuing at the food court, the accused came up to her and told her there was a Bangladeshi and an Indonesian maid fighting in the mall's carpark.

Thinking that the Indonesian maid involved could be one of her friends, the victim followed Nurul Islam to the fourth floor of the carpark, but found nobody there.

Realising something was amiss, she tried to leave, but Nurul Islam pulled her hair, dragged her to a corner and pushed her against the wall. He then molested her and forcibly stripped her.

The victim tried to push him away, but Nurul Islam bit her lip and slapped her face. He pinned her onto the ground and tried to force himself on her. When he failed, he violated her with his finger instead.

After the victim continued to struggle violently for a few more minutes, the accused decided he was too exhausted to persist. He threw the victim's clothes at her and told her to leave.

The victim fled home, crying. Her employers called the police and she was sent to National University Hospital.

Deputy Public Prosecutor Lee Zu Zhao said that the accused had committed his crime "in a brazen manner, in a residential area". He added that Nurul Islam had used violence above what was necessary, as "he was strong enough to overpower her without having to slap or bite her".

In his mitigation, the accused said he was sorry for having committed the mistake and asked for the lightest possible sentence, so that he could return to Bangladesh to look after his parents.

For each charge of attempted rape or sexually penetrating the victim, Nurul Islam could have been jailed for up to 20 years and also liable to a fine or caning.

Indonesian student, 26, jailed for touching woman's buttock with his groin on MRT

An Indonesian PhD student was convicted on Tuesday of outraging a woman's modesty on an MRT train.
According to The Straits Times, Irfan Syanjaya, 26, had been taking the train from Buona Vista to Jurong East on Aug 12 last year, when he deliberately stood close behind the 20-year-old student to do so.
