Girl attacked at home: Rapist fails in appeal

A rapist who met his victim through a 'making friends' column in a teen magazine has had his appeal dismissed.

Wang Jianbin, 25, attacked the schoolgirl in her bedroom after fighting off a male friend of hers who tried to stop him.

He later challenged his sentence of 13 years of jail and 15 strokes of the cane, but it was upheld on Wednesday by the Court of Appeal.

Justice Chao Hick Tin said it was a horrendous case that was unusual, as the rapist had gone to the victim's home and attacked her in the presence of others.

*Update: MINDEF has clarified that Samuel Wang Jian Bin was not a Commando as stated in the court papers,*but he was attached to the logistic liaison team in the Commando Training Institute as a supply assistant during his National Service.

THEY got to know each other through a pen pal column in a teen magazine and became online friends.

But when her new pal started sending her sexually explicit text messages and asking to meet her, the 13-year-old girl tried to cut off contact.

But Samuel Wang Jian Bin, 24, a polytechnic student, wouldn't take no for an answer.

Instead, Wang, who was a commando during national service, forced his way into her flat by threatening to call his "gang" down.

While the girl's younger brother was having his piano lesson in the living room and two of her male friends were in another room, Wang raped her in her own bedroom.

He did not stop his attack even when hit on the back with a martial arts spear.

Yesterday, Wang pleaded guilty to one count of statutory rape. He was jailed 13 years and ordered to be given 15 strokes of the cane.

One charge of criminal intimidation and another charge of sexual penetration of a minor under 14 were taken into consideration during sentencing.

His sentence was backdated to his remand date of Dec 2, 2009.

There is a court order not to name the victim, now 14, or publish any details that could reveal her identity.

Deputy Public Prosecutor Chua Ying-Hong said the China-born Wang came here with his family at the age of 11 and became a Singapore citizen eight years later.

On Dec 2, 2009, about two months after he had first met the girl online, he turned up at her flat. It was their first face-to-face encounter and she recognised him from his photo on Facebook.

In the days and hours before this, Wang had fired the girl a series of threats and sent her lewd text messages.

Outside her unit, he again threatened her.

She let him in as he said he would call his "gang" if she did not take him to her room immediately. And he took out his mobile phone as if he was about to call someone.

Out of fear, she complied. He followed behind her, pushing her back as he did so.

On the way, they walked past the living room where her younger brother was with his piano teacher.

Two of her male friends, one of whom had been called there to help protect her, saw Wang. The other friend, now 17, called the police.

Wang shut her room door but left it unlocked upon the girl's request. She thought that Wang would not dare to do anything to her as there were all the other people in the flat.

She was wrong. He told her he wanted to hug her, pushed her onto the bed and began molesting her.

She said he had only asked for a hug. She also told him to get away from her before she screamed for help.

He warned her that if she screamed, he would call his "gang" and tell her parents that she had had sex with her boyfriend.

He then sexually assaulted her. She tried to push him away but failed.

At this point, one of her male friends opened her room door and caught Wang in the act.

The boy, who is now 18, hit Wang's back with the blunt end of a martial arts spear that belonged to the girl's brother.

Wang struggled with the teenage boy for some time until he told the girl to get her friend to leave, and repeated his earlier threats. The girl whispered to her friend to call the police.

The friend left the room and went with the other male friend to seek help.

Meanwhile, Wang resumed molesting the girl and eventually raped her.

When the girl later heard her male friend's voice from outside, she said the police had arrived. Wang and the girl then walked out of the room.

Singapore Civil Defence Force (SCDF) officers who arrived on the scene then separated Wang from the girl.

Wang was subsequently arrested by the police.

Later that day, he sent the girl a text message apologising for his actions.

The court heard that Wang had first contacted the girl via MSN in October 2009. He had come across her e-mail address in the "making friends" column of Teenage magazine.

They would chat on MSN from time to time.

Through their online conversations, Wang came to know the girl's real name, age and that she was a Secondary One student.

They later exchanged mobile phone numbers after he asked her for hers. They started to have phone conversations and also communicated through text messages.

But things soon became uncomfortable for the girl when Wang started asking her intimate questions.

She began avoiding his calls but he wouldn't take the hint.

Instead, he kept sending her numerous text messages asking to meet her. Wang also asked her if she had a boyfriend and if she had had sex with her boyfriend.

To fend him off, the girl said yes to both questions.

She told him she was not interested in meeting him and to stop sending her text messages.

But Wang was not deterred.

On Dec 2, he sent her a series of text messages asking for her address and to meet her at her home.

When he learnt that she was with a male friend, he told her to tell her friend to watch out as he could bring his "gang" down any time.

He also threatened to "play gangster" with her and to find trouble with her friend if she did not tell him her address.

The girl refused to meet him and tried to keep him away by giving a range of excuses. She had a male friend to pose as her father and call Wang to tell him to end the harassment.

But Wang was unconvinced and insisted on going to the girl's flat. The friend called another friend to help them at the flat.

He also called the police. But he told them there was no need to send officers yet and he would call again if Wang appeared.

When Wang said he knew her address and threatened to bring his "gang" to her home to "disturb" her and "mess up" her flat, the frightened girl asked the two boys to hide inside her mother's room when Wang arrived.

She told them to call for help if she could not handle Wang. They did, but by then, it was too late.

Dr Cai Yiming, a senior consultant psychiatrist at the Institute of Mental Health (IMH), diagnosed the girl to be suffering from post-traumatic stress disorder which was likely to last at least six months.

In his psychiatric report, he stated that she had trouble sleeping and awoke easily after every few hours.

She was irritable and would be easily agitated and "boiling inside" when her younger brother talked about rape.

She had flashbacks of what happened to her and started to imagine perverted things. She had also become sensitive to boys and whatever they did seemed wrong to her.

In his mitigation, Wang's lawyer Irving Choh said his client, who lived with his mother, a 47-year-old hawker assistant, and 11-year-old sister, had been greatly affected by his parents' divorce in 2009.

He said Wang was an impressionable young man who found the girl attractive and that his curiosity and emotions got the better of him.

Mr Choh also produced testimonials to show Wang's good character.

He said Wang's parents, who turned up yesterday with a few relatives and friends, felt responsible for what had happened as they had been too caught up with their own disputes then.

For statutory rape, Wang could have been jailed 20 years and fined or caned.
