SINGAPORE: A man who posted a S$100,000 bail for his younger brother so he could marry his pregnant girlfriend will lose S$85,000 of the money as his brother had absconded.

Marketing manager, Mr Maqbool Ahmed Khan, 32, had posted the money for Irfan Ahmed Khan Iqbal Ahmed Khan, 28, and even lent him his car to get married.

But Irfan, who faces mainly drug-related charges, escaped in June before Malaysian authorities caught him in Johor about two weeks later.

On Friday, district Judge John Ng not only ordered the forfeiture of S$85,000 of the total bail amount, he also chided Mr Maqbool for not ensuring Irfan did not abscond.

Judge Ng pointed out that Mr Maqbool had loaned his car to Irfan without hesitation when his younger brother wanted to use it.

Because of this, the judge added that instead of ensuring that Irfan's movements were within his supervision, Mr Maqbool had unwittingly given him the opportunity to abscond.

Judge Ng also said Mr Maqbool had failed to "exercise due diligence in the discharge of his duties as a bailor".

However, the judge took into account that Irfan was re-arrested within 17 days after he ran away, saying this was the only positive aspect of the case for Mr Maqbool's situation.

But Judge Ng also noted that Mr Maqbool was not involved in his sibling's re-capture.

The judge added that a larger sum would have been returned to Mr Maqbool had he contributed to his brother's re-capture.

Mr Maqbool later told reporters outside the courtroom that he was satisfied with the outcome.

Irfan is now back in remand and his case is still pending.

His pre-trial conference will be held on Monday.

Man who jumped bail gets 22 years' jail, 15 strokes of cane

By Alvina Soh | Posted: 05 April 2012 1802 hrs

SINGAPORE: A man who jumped bail and fled to Malaysia while awaiting trial for drug trafficking has been sentenced to 22 years' jail and 15 strokes of the cane.

The court found 29-year-old Irfan Ahmed Khan guilty of several offences.

These include trafficking methamphetamine, possessing offensive weapons and attacking police officers.

Irfan skipped town after he was granted a day's bail to get married in June last year.

He did not turn up for his wedding solemnisation and failed to show up in court on June 7, 2011.

A warrant of arrest was issued against him.

After 17 days on the run, he was caught in Johor on June 23.

More than three-quarters of the bail amount of S$100,000 put up by his family had been forfeited.

Investigations revealed that Irfan sought refuge at his brother-in-law's home and ignored advice to turn himself in.

A few days later, he escaped to Malaysia with the help of an accomplice.

He hid among several large rattan baskets containing vegetables on his friend's lorry, which was bound for Johor Bahru.

He was arrested in a joint operation by Singapore's Central Narcotics Bureau and its Malaysian counterpart.

He had been caught for drug trafficking, but pleaded to be let out on bail to get married to his pregnant fiancee.

But after his mother paid with money from the sale of her flat, he abandoned his bride and fled to Malaysia.

On Thursday, Irfan Ahmed Khan, 29, was convicted of eight charges which, apart from absconding and leaving Singapore without a valid passport, included drug trafficking and attacking three police officers. He was sentenced to a total of 22 years in jail and 15 strokes of the cane.

The sentence marked the end of a two-year period over which the unemployed man repeated behaviour that was to become a pattern. His family would post bail for him, only for him to commit another crime while out on bail, and he would be taken into custody again.
